Petition for MTO Subsidy for the
2004 Connecting Link Program |

RECOMMENDATION:
That the report entitled
“Petition for MTO Subsidy for the 2004 Connecting Link Program” be received;
That the Operations and Asset Management Department
be authorized to petition for the statutory subsidy pursuant to The Public
Transportation and Highway Improvement Act on expenditures for 2004 Connecting
Link Construction Projects to facilitate the 16th Avenue / Markham
Road Intersection Improvements;
And that Council approve the
attached Schedule A - Connecting Link Construction By-Law to authorize the
execution of a proposal and estimated costs for the construction of a
connecting link designated by the Minister of Transportation.
PURPOSE:
Pursuant to the Public
Transportation and Highway Improvement Act, the Council must petition the
Province of Ontario to request an allocation of subsidy funds for the
Connecting Link Program. These funds
shall be expended on the Connecting Link in accordance with the Act. A detailed
statement of the proposed expenditures is included in Schedule B attached.
The Ministry will not release interim subsidy
payments until such time as Council has passed the Connecting Link Construction
By-Law.
BACKGROUND:
In October 2003, Council endorsed in principle
the “Main Street Markham Streetscape and Traffic Management Study” and
authorized the Construction and Utilities Department to proceed with Phase I
construction, the 16th Avenue / Markham Road Intersection
Improvements. This
intersection improvement project involves works
within the jurisdiction of the Region of York, the MTO and the Town of Markham.
The Region of York and MTO had committed to funding contribution and cost share
the project. The Town’s portion of Markham Road is under the Connecting Link
Agreement with the MTO. The Town’s share of cost is funded from 2003 Capital
Budget, Account No. 83-5350-5208-005.
In a letter to the Town dated January 26, 2004,
MTO confirmed its commitment of $25,000 for this project through the 2003/2004
Connecting Link Program for the proposed work within the connecting link limits
(i.e. the portion of Markham Road south of 16th Avenue). The $25,000
allocation was approved by MTO in May 2004 based on preliminary conceptual
plan. The MTO share of cost based on
detail design is now estimated at $80,052 (90% of $88,948). Staff will apply
for the balance ($55,052) under the 2005 Connecting Link Program. Note that
this amount will be adjusted after the project is tendered and will be included
in the tender award report.
It is proposed that this intersection
improvement project be tendered in September 2004, pending final design
approval by MTO and ROY. Pursuant to the Public
Transportation and Highway Improvement Act, the Council must petition the
Province of Ontario to request an allocation of subsidy funds for the
Connecting Link Program.
The
MTO subsidy rate for connecting link construction projects in 2004 is 90%. In order to conform with the provisions of the Connecting Link
Agreement, the portion within the connecting link limits must be completed
prior to March 31, 2005.
BUSINESS UNITS CONSULTED AND AFFECTED:
The
petition for subsidy and By-Law has been reviewed by the Finance and Legal
Departments.
