SUBJECT:

Designation of the Waterworks Overall Responsible Operator under Regulation 128/04 and Regulation 129/04

 

 

 


 

 

RECOMMENDATION:

THAT the report entitled “Designation of the Waterworks Overall Responsible Operator under Regulation 128/04 and Regulation 129/04” be received;

 

AND THAT Council designate Waterworks Manager of Operations & Maintenance, Robert Flindall, as the Overall Responsible Operator (Water Distribution Subsystem) for the purpose of Ontario Regulation 128/04 made under the Safe Drinking Water Act, 2002;

 

AND THAT the Overall Responsible Operator or General Manager be authorized to designate an Overall Responsible Operator to act in his place when he is absent or unable to act as permitted under Ontario Regulation 128/04 made under the Safe Drinking Water Act, 2002;

 

AND THAT Council designate the Waterworks Operations & Maintenance, Robert Flindall, as an Overall Responsible Operator (Wastewater Collection Facility) for the purpose of Ontario Regulation 129/04 made under the Ontario Water Resources Act.

 

AND FURTHER THAT the Overall Responsible Operator or General Manager be authorized to designate an overall responsible operator to act in his place when he is absent or unable to act as permitted under Ontario Regulation 129/04 made under the Ontario Water Resources Act.

 

PURPOSE:

 

To have Council designate Town personnel as required under these regulations.  The designation of the Overall Responsible Operator will be transferred from Mr. William Dawson to Mr. Robert Flindall, Waterworks Manager of Operations & Maintenance.

BACKGROUND:

 

Two new provincial regulations were filed on May 14, 2004, and came into force on August 1, 2004; Ontario Regulation 128/04 made under the Safe Drinking Water Act (SDWA) deals with Certification of Drinking-Water System Operators and Water Quality Analysts; Ontario Regulation 129/04 made under the Ontario Water resources Act (OWRA) deals with Licensing of Sewage Works Operators.  Both regulations require that the owner or operating authority of a municipal residential subsystem designate as overall responsible operator of the subsystem an operator who holds a certificate for that type of subsystem and that is of the same class as or higher than the class of that subsystem.  The purpose of designating an Overall Responsible Operator is to ensure that a knowledgeable, experienced staff person is available at all times to provide advice to all operators working within the system, and to respond to emergencies.

 

At present the Markham water distribution system is classified as a Class 2 subsystem.  The Markham wastewater collection system is classified as a Class 3 facility.

 

At the meeting of June 30, 2004 Council designated Waterworks Supervisor Mr. William Dawson as the Overall Responsible Operator under Regulation 128/04 and Regulation 129/04.

 

 

OPTION/DISCUSSION:

 

The Waterworks Manager of Operations and Maintenance, Mr. Robert Flindall P.Eng., currently holds a Class 2 Certificate for Water Distribution Systems and a Class 3 Certificate for Wastewater Collection Facilities.

 

The duties of the Overall Responsible Operator for both Water Distribution and Wastewater Collection are consistent with the duties and responsibilities of the Manager of Operations and Maintenance.  When the Overall Responsible Operator is absent or unable to act the ORO or the Waterworks General Manager would designate the next most senior Waterworks Supervisor to

act as the ORO.  The Overall Responsible Operator may designate the Supervisor working on Standby as the ORO for overnight and weekend shifts, if necessary, according to operational needs.

 

A record of the designated ORO is kept in the Operators log book which is maintained at the Miller Works Works Yard.

 

 

FINANCIAL CONSIDERATIONS:

 

There are no financial considerations related to the designation of the Overall Responsible Operator.

 

BUSINESS UNITS CONSULTED AND AFFECTED:
