A by-law to amend By-law 165-80, as amended.
THE COUNCIL OF THE CORPORATION OF THE TOWN OF
1. That By-law 165-80, as amended, be and the same is hereby further amended as follows:
1.1 By re-zoning the lands shown on Schedule ‘A’ attached hereto, to Hold Special Commercial One [(H) SC1] and Special Commercial One (SC1).
1.2 By adding to Section 7 – Exceptions the following new subsection:
“7.106 Notwithstanding any other provisions of this By-law, the provisions in this Section shall apply to Concession 4, Part of Lot 9, municipally known as 8221 Woodbine Avenue, as shown on Schedule ‘A’ attached to By-law XXXX. All other provisions of this By-law, unless specifically modified/amended by this section, continue to apply to the lands subject to this Section.
7.106.1 Additional Permitted
Uses
The following additional uses are permitted:
a) RESTAURANTS;
b) Retail sales.
7.106.2 Prohibited Uses
a) Retail lumber and building supplies
7.106.3 Special Site Provisions
The following additional provisions shall apply:
a) The minimum retail GROSS FLOOR AREA, per premise,
is 300m2
b) The minimum distance between any two buildings on a lot provision shall not apply.
c) For the purposes of determining setback and
parking requirements, Phase 1 and Phase 2 shall be considered as one
7.106.4 Zone Standards
The following specific zone standards apply:
a) Minimum required lot frontage:
i) abutting an arterial road or
ii) abutting all other streets – 15 metres
b) Minimum required landscaped open space:
i) Adjoining an
arterial road (
ii)
Adjoining all other streets (
iii) Adjoining the north lot line – 3 metres
iv) Adjoining the south lot line – 3 metres
c) The maximum height – 6 storeys
d) The Holding (H) provision shall apply to the subject lands, as outlined on
Schedule ‘A’ attached hereto and shall not be removed until the owner
submits a traffic study for the lands and enters into a site plan agreement with
the Town.
2. All other provisions of By-law 165-80, as
amended, not inconsistent with the provisions of this by-law shall continue to
apply.
