A By-law to amend By-law 90-81, as amended
THE COUNCIL OF THE
CORPORATION OF THE TOWN OF

THAT By-law 90-81, as amended, is hereby further
amended, as follows:
1.1 By adding the following ZONE category to
subsection 5.1 (a):
ZONE SYMBOL
SECOND DENSITY – HIGH DENSITY
RESIDENTIAL RHD2
1.2 By rezoning the lands within the
designated area of this By-law, as outlined on Schedule ‘A’ attached hereto,
from Community Commercial (CC) to Second Density – High Density Residential (RHD2).
1.3 By adding to Section 7 – EXCEPTIONS the
following new subsection:
7.__ The provisions in this section shall apply
to those lands zoned Second Density – High Density Residential (RHD2) within
the designated area of this By-law as shown on Schedule ‘A’ attached to By-law
2006-XXX. All other provisions of this
By-law, unless specifically modified/amended by this section, continue to apply
to the lands subject to this section.

The
following uses are the only uses permitted:
- APARTMENT DWELLINGS
2.0 Zone Standards
The following specific zone standards apply:
a) Minimum LOT
FRONTAGE – 90 metres
b) Minimum LOT AREA
– 0.7 hectares
c) MINIMUM FRONT
YARD – 4.0 metres
d) MINIMUM REAR YARD
– 35.0 metres
e) MINIMUM SIDE YARD
– 8.0 metres
f) Maximum Number of
STOREYS – 4
g) MAXIMUM
h) Minimum Landscaped
Area – 30%
i)
Maximum Number of Units – 52
j)
Maximum GROSS FLOOR AREA – 9,000 square metres

Special Site Provisions
The following additional provisions apply:
a) Landscaping Requirements:
i)
The area between the front lot line and the building
shall only be used for LANDSCAPED OPEN SPACE.
ii)
Minimum Landscape strip along north lot line – 8
metres
iii)
Minimum Landscape strip along west lot line – 2.5
metres
b) The following
provisions shall not apply:
i) SETBACKS to the centreline of any arterial
road or
2 All other provisions of By-law 90-81,
as amended, not inconsistent with the provisions of this by-law, shall continue
to apply.

LANDS AFFECTED
This proposed by-law amendment applies to approximately 0.72
hectares (1.78 acres) on the west side of
EXISTING ZONING
The lands subject to this By-law are presently zoned Community Commercial (CC) in By-law 90-81, as amended.
PURPOSE OF THE BY-LAW
The purpose of the By-law amendment is to rezone the subject lands to Second Density – High Density Residential (RHD2) to permit an apartment building.
EFFECT OF THE BY-LAW
The effect of the zoning by-law amendment is to permit the
development of a four-storey 52-unit apartment building on the subject lands.
