SUBJECT:                          Canadian Motorcycle & Extreme Sports Festival- Noise By-law Exemption

RECOMMENDATION:

 

THAT Committee approve the following exemptions to By-law 2003-137 (Noise By-law) for the Canadian Motorcycle & Extreme Sports Festival:

 

    On June 16, allow amplified music to 7 p.m.

    On June 17, allow amplified music to 7 p.m and vehicle noise from noon to 7 p.m.

    On June 18, allow noise from vehicle noise from noon to 4 p.m.

PURPOSE:


 

To grant the operators of the Canadian Motorcycle & Extreme Sports Festival an exemption from the Town’s Noise By-law.


 


 

BACKGROUND:


The operators of the Canadian Motorcycle & Extreme Sports Festival- June 16th to 18th at the Markham Fairgrounds has requested exemptions to the Noise By-law for amplified music past the prescribed time and for the operation of vehicles  (motorcycles, trail bikes, snowmobiles, etc.) which are prohibited at all times other than on highways or places intended for automobile operation.

 

The exemptions for amplified music are required for music from within an outdoor tent that will occur until 7 p.m. on Friday and Saturday. The by-law restricts amplification of music to 5 p.m. each. The second exemption is required as the operation of motorcycles, trail bikes, snowmobiles, etc are prohibited at all times other than on highways or places intended for automobile operation, such as a race track.


 


 

OPTIONS/ DISCUSSION:


Noise by-laws are restrictive in scope to ensure the residents enjoy an environment free from unusual, unnecessary, or excessive noise. With the restrictive nature, the by-law contains provisions for the Manager, By-law Enforcement & Licencing and Council to grant exemptions to the by-law where specific community events or occurrences warrant an exemption.  

 

By-law provisions require Council approval for an exemption to allow for the operation of the vehicles at Fairgrounds, other than for normal use. Use of vehicles for racing, demonstrations, and exhibitions and the associated higher levels of noise with those activities can be disruptive to everyday residential activities.

 

The operators have received Council endorsement for designation as a Significant Event in conjunction with Special Permit Liquor Licence Application. An ad advising the community of the noise by-law exemption was placed in the Markham Economist & Sun. The noise exemption periods are limited to afternoon and early evening periods only.

The Canadian Motorcycle & Extreme Sports Festival has applied to the Town of Markham for an exemption to

Noise By-Law 2003-137

 

Exemption is required to allow for activities associated with the upcoming festival. Activities requiring an exemption include:

 

Amplified Music

Allow to 7 p.m. on Friday & Saturday; whereas, by-law does not permit past 5 p.m.

 

Noise from Operation of Trail Bikes, Track Bikes, and Snowmobiles

Allow from Noon to 7 p.m on Saturday and from Noon to 4 p.m. on Sunday; whereas, by-law does not permit the noise from identified vehicles at that location at any time
