RECOMMENDATION:

That the report entitled “Amendment to conditions of Site Plan Approval Costco Wholesale (Canada) Ltd 65 Kirkham Drive” be received;

 

That Condition 4(b) of the conditions of endorsement of the Site Plan for Costco at the above noted location be deleted;

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to recommend an amendment to the conditions of approval for the Costco Site Plan application, to delete the requirement that the plan of subdivision for the Costco site and other lands be registered prior to final site plan approval.

 

BACKGROUND:

On February 28, 2006, Council gave draft plan approval to a plan of subdivision on lands at the southeast corner of Markham Road and Kirkham Drive.   The plan of subdivision consists of three commercial blocks and public roads.  At the same meeting, Council endorsed the site plan application submitted by  Costco Wholesale (Canada) Ltd. for a 13,829m2  (148,854 sf) club warehouse store on one of the blocks to be created by the registration of the subdivision. 

 

OPTIONS/ DISCUSSION:

Costco has been working with the Town to finalize its site plan approval for its store on Kirkham Drive just east of Markham Road and all conditions of the endorsement of the site plan have been complied with, with the exception of the registration of the plan of subdivision which comprises the Costco store site and other lands, fronting on Markham Road.  Costco’s store is scheduled to open on March 30th, 2007.

 

The plan of subdivision is very close to being registered.  Staff expect the subdivision agreement to be executed and all financial securities filed with the Town prior to the proposed store opening on March 30th, 2007.  However, final site plan approval cannot be issued as the conditions require the registration of the plan of subdivision.

 

Staff are confident that the plan of subdivision will be registered within a reasonably short time frame after the execution of the subdivision agreement.  The landowners have undertaken to register the plan of subdivision within 60 days of execution of the subdivision agreement. Satisfactory arrangements, including insurance, indemnities and signage have been made to permit the public to access the site via the roads within the draft plan of subdivision, which have been constructed to municipal standards. The Region has also given its approval to the use of the accesses to Markham Road.

 

Deletion of the site plan requirement for the plan of subdivision to be registered  will permit the Director of Planning and Urban Design to finalize the site plan approval and will facilitate the opening of the Costco store on March 30th.
