PURPOSE:


The purpose of this report is to recommend amending the schedule of By-law 2006-331, which was enacted by Council in November, 2006.


 

BACKGROUND:


On November 28, 2006, Council endorsed a staff report recommending draft plan approval and zoning by-law amendments to permit six single detached dwellings and a park block at 93 Helen Avenue, on the south side, east of Kennedy Road.  The staff report had a draft zoning by-law appended to it which was enacted at that Council meeting. 

 

Notice of the enactment of the by-law (By-law 2006-331) was duly given and no appeals were filed.  Conditional Draft Plan Approval has been issued.  Subsequently, it has come to staff’s attention that the Schedule A attached to the by-law was an earlier draft which was inadvertently included in the package for enactment.  This earlier draft did not properly delineate the final location of the park block nor did it identify the lands as being subject to Holding (H) provisions. 


 

OPTIONS/ DISCUSSION:


In order to ensure the appropriate standards are in place which reflect Council’s approval of the application, Schedule A of By-law needs to be amended.  In addition, the reference to the Open Space zone contained in By-law 2006-331 should be amended to reflect the Open Space One (OS1) category as set out in By-law 177-96.  This matter has been discussed with the Town Solicitor, who advises that a further public meeting will be required. 

Clerks Department records indicate that 29 notices were mailed out in conjunction with the original public meeting held on this application, and that only one person made a deputation at the meeting.  Mr. Glenn Baron, of 251 Helen Avenue, stated concerns for traffic and pedestrian safety on Helen Avenue, discussed servicing issues and requested sewer laterals be provided for his property.  The same notice circulation will be followed again.
