RECOMMENDATION:

 

That Council enact the attached draft zoning by-law amendments;

 

And that Council be advised that staff approval of the red line revisions to draft plan of subdivision 19TM-02015 (Phase II - revised) will follow enactment of the zoning by-laws.

 

BACKGROUND:

 

On June 7, 2005, a Development Services Committee public meeting was held to consider applications for subdivision approval and zoning by-law amendments to permit 71 single detached and 144 townhouse dwellings (total 215 units) and 4.5 hectares of employment land within Draft Plan of subdivision 19TM-02015. 

 

On June 13, 2006, Council granted draft plan approval and enacted zoning by-law amendments to permit development of the Phase I portion of the subdivision, consisting of 97 residential units.  These Phase I units were part of a larger allocation of 800 units to the West Cathedral Community, granted by Council in February and November 2005, of which 98 units were assigned to the Majorwood subdivision by the Landowners’ Group.

 

On December 8, 2006, an additional 24 residential units were draft plan approved (total 122 units) through staff-approved redline revisions to the draft plan of subdivision, in accordance with Delegation By-law 2002-202, as amended.  These Phase II units were part of an additional 300 units of servicing allocation granted to the West Cathedral Community by Council on June 20, 2006, of which 26 units were assigned to the Majorwood subdivision by the Landowners’ Group (total 124 units).  Associated zoning by-law amendments to permit residential development on these 24 lots were enacted by Council on November 21, 2006. 

 

In March 2007, the owner requested to add 3 part lots and delete 2 full lots from the draft plan of subdivision, and to realign other part lots abutting the property to the north, in order to better coordinate development of this subdivision with the one to the north.  These proposed changes to the draft plan are consistent with the subdivision layout presented at the June 2005 public meeting. 

 

The net result is an increase of 0.5 lots to the draft plan (total 122.5 lots approved to date), which is less than the total number of units of servicing allocation granted to this subdivision by the Landowners’ Group (124 units).

 

Two of the part lots comprising the March 2007 draft plan amendment are located outside of the original Phase I and Phase II draft plan boundaries, and need to be deleted from the Agricultural Area By-law (304-87) and incorporated into the Urban Expansion Area By-law (177-96).  This is the subject of the draft zoning by-law amendments, attached.

 

Delegated approval of the draft plan of subdivision by the Director of Planning and Urban Design will follow Council approval of the implementing zoning by-law amendments, in accordance with Section 2(b) (iv) of Delegation By-law 2002-202.
