SUBJECT:                          Review of Citizen Requests for Town-Wide Three-hour Maximum Parking Restriction

RECOMMENDATION:

That the report entitled “Review of Citizen Requests for Town-Wide Three-hour Maximum Parking Restriction” dated May 29, 2007, be received;

 

And that a Town-Wide three-hour maximum parking restriction by-law not be implemented at this time;

 

And that by-law 2005-188, Schedule “D”, entitled “Parking for a Restricted Period” continue to be enforced as a means of restricting parking on an individual basis, where conditions are justified;

 

And that staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

This report responds to a deputation requesting a Town-Wide three-hour maximum parking restriction by-law.

 

BACKGROUND:

Mr. Peter MacLeod of Aberfeldy Crescent made a deputation to the January 22, 2007 General Committee, requesting a Town-Wide three-hour maximum parking restriction by-law.   The General Committee directed staff to report back regarding the feasibility of enacting such a by-law.

 

OPTIONS / DISCUSSION:

Engineering staff researched the implementation of a Town-Wide three-hour maximum parking restriction by-law and also reviewed practices followed by other municipalities.  Currently, a number of neighbouring municipalities have established an area-wide three-hour maximum parking restriction by-law.  These municipalities typically enforce the by-law on a complaint basis only.

 

The By-law Enforcement Section has expressed that by implementing a Town-Wide three-hour maximum parking restriction by-law, significant additional resources would be necessary to effectively provide monitoring and enforcement of the parking restriction.

 

The existing Town of Markham parking by-law 2005-188, Schedule “D”, entitled “Parking for a Restricted Period”, allows the Town to provide time-based parking restrictions on specified Town streets.  The implementation of a time-based restriction is utilized on an individual basis and only if conditions are justified.  This practice addresses only streets that experience problems with parking, thereby effectively using current enforcement resources.

 

The Engineering and By-law Enforcement Departments agree that current practices are effective in addressing parking concerns and that a Town-Wide restriction is not justified at this time.

 

Should Mr. MacLeod wish to pursue a three-hour maximum parking restriction by-law on Aberfeldy Crescent, he would be required to provide a petition to the Town’s Clerks Office with at least 60% of households on the subject street in support of implementing the restriction.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

The By-law Enforcement Department has been notified of the request for a Town-Wide three-hour maximum parking restriction by-law. Their concerns have been incorporated in this report.
