RECOMMENDATION:
That the report entitled “Castlemore Avenue Extension, from the Donald
Cousens Parkway to the East Limit of Castlemore Avenue in the Greensborough Secondary Plan”, dated November 20, 2007, be received;
And that the Mayor and the Clerk be authorized
to execute a construction agreement with Humbold Properties Limited to complete Castlemore Avenue running east from the Donald Cousens
Parkway , at the developers cost, in a form satisfactory to the Chief
Administrative Officer and Town Solicitor, provided that Humbold Properties
Limited provides evidence, satisfactory to the Town Solicitor, that the
requirements of the Municipal Class Environmental Assessment have been met;
And that staff
be authorized and directed to do all things necessary to give effect to this
resolution.

FINANCIAL CONSIDERATIONS:
The construction of Castlemore Avenue from the Donald Cousens Parkway to the east limit of Castlemore Avenue will be financed by Humbold Properties Limited and is estimated at $120,000.
There is no financial impact to the
Town.
PURPOSE:
The
purpose of this report is to obtain Council’s approval
to execute a construction agreement for the construction of a section of Castlemore Avenue from the Donald Cousens
Parkway to the east limit of Castlemore
Avenue (approximately 60m).
BACKGROUND:
Castlemore Avenue is an east-west 3-lane minor
collector that runs parallel to Major Mackenzie Drive from Kennedy Road to the Donald Cousens Parkway.
There is a portion that remains to be constructed on the east side of
the Donald Cousens Parkway, as per Attachment “A”.
The Donald Cousens Parkway is located at the eastern boundary
of the Greensborough Community. There
are developable table lands between the Parkway and the Little Rouge
River. As Donald Cousens Parkway is designed to be a Regional Road with restricted access, a short
extension of Castlemore Avenue is required to provide access to the
developable table lands and an existing municipal stormwater management
pond. This section of Castlemore Avenue has been included in “The
Neighbourhoods of Greensborough Community Design Plan”, prepared by KLM Planning Partners Inc., and approved by the
Town on July 17, 2000.
The land east of Donald Cousens Parkway is owned by Humbold Properties
Limited.
The construction and dedication of this
extension of Castlemore Avenue will sever the developable tableland into two
parcels. Preliminary proposals include a
condo townhouse project on the northerly parcel and a place of worship on the
southerly parcel. Any development
proposed for these parcels will be subject to review and approval of rezoning
and site plan applications. The Planning Department has advised they have no
objection to the creation of these two parcels through the dedication of this
road extension.
The Engineering Department has no objection to the
proposed extension as there is limited amount of public works that have to be
constructed. A construction agreement is
required for the construction of the road.
The underground services for this section of Castlemore Avenue were constructed in 2000-2001 under
a previous core servicing agreement but are not assumed yet. The construction of the road and aboveground
services is the subject of this report.
The Town currently has an easement over this portion of land for access
to the stormwater management pond. This
easement will be removed after the dedication of the road as a public highway.
The right-of-way will be conveyed to the Town
through this agreement. Through the
conveyance of the right-of-way to the Town, this effectively severs the land
into two separate parcels for future development.
This agreement
outlines the responsibilities of the developer for construction, security and
maintenance of the road.
The owner, as the proponent of the road
construction, will be required to comply with the provisions of the Municipal
Class Environmental Assessment. Evidence
of compliance will be required prior to the execution of the construction
agreement.
