SUBJECT:                          Riverlands Avenue East of Bur Oak in the Cornell Community

RECOMMENDATION:

That the report entitled “Riverlands Avenue East of Bur Oak Avenue in the Cornell Community”, dated November 20, 2007 be received;

 

And that Parts 2 to 5 inclusive and Part 10 on Plan 65R-28526 (closed portion of Riverlands Avenue) remain in the Town’s ownership to allow maintenance and operations of existing underground municipal services;

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to follow up on a previous staff report presented to Development Services Committee on November 21, 2006 entitled “Closure of Temporary Section of Riverlands Avenue East of Bur Oak Avenue in the Cornell Community”.

 

 

BACKGROUND:

In a report dated November 21, 2006 entitled “Closure of Temporary Section of Riverlands Avenue East of Bur Oak Avenue in the Cornell Community”, staff requested that a temporary section of Riverlands Avenue be closed when Bur Oak Avenue from Church Street to Highway 7 was opened to the public, and to re-convey the closed road to the previous owner, Wykland Estates Inc.

 

 

OPTIONS/ DISCUSSION:

After Bur Oak Avenue between Riverlands Avenue and Highway 7 was opened to the public, the subject section of Riverlands Avenue was closed.  The conveyance back to Wykland Estates Inc. has not taken place yet because there are existing underground municipal services in the right of way.  Riverlands Avenue will be a future local road and will be assumed in the future when the adjacent residential lands are developed.  Staff have discussed with Wykland Estates and mutually agreed that rather than conveying the land back to Wykland and then taking an easement in favour of the Town for the underground municipal services, the closed portion of the road can remain in the Town’s ownership.

 

If the ultimate Riverlands Avenue alignment is adjusted due to the final draft plans of subdivision on the adjacent lands, the appropriate legal surveys can be prepared at that time to effect the changes in the property boundaries.
