SUBJECT:                          Town Conveyance to Stringbridge Investments Limited

                                            Surplus Lands Outside the Road Allowance Known as

                                            Clegg Road – Block 13, Plan 65M-2668, Markham

RECOMMENDATION:

THAT a by-law be enacted to stop up and close that portion of the surplus Clegg Road turning circle legally described as Block 13, Plan 65M-2668;

 

AND THAT the portion of the surplus Clegg Road turning circle being lands legally described as Block 13, Plan 65M-2668 be declared surplus pursuant to Town of Markham By-law 178-96 and that notice of the proposed disposition of such lands be placed on the agenda for the Council meeting of June 12, 2007;

 

AND THAT a by-law be enacted at Council on June 12, 2007, authorizing the Mayor and Clerk to execute a Transfer of Land and other related documents for the completion of the conveyancing required, in a form satisfactory to the Town Solicitor.

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to obtain Council approval and the enactment of the necessary by-laws to allow the conveyancing for the disposal of surplus lands now outside the current Clegg Road right-of-way.

 

BACKGROUND:

On August 26, 2002, the Town entered into a Site Plan Control Agreement with Stringbridge Investments Limited for the construction of two warehouse/office buildings on lands legally described as Block 1, Plan 65M-2668.  At the time of this Agreement, Clegg Road ended in a turning circle west of South Town Centre Blvd.  Clegg Road has now been extended to Rodick Road (See Appendix 1). 

 

The Site Plan Control Agreement called for Stringbridge Investments Limited to convey Part 13, Plan 65R-25277 to the Town to form part of the extended Clegg Road in exchange for the return of that part of the turning circle, being Block 13, Plan 65M-2668 that became surplus when Clegg Road was extended (See Appendix 2).  The Town was conveyed Part 13, Plan 65R-25277 by the registration of a Transfer on November 18, 2002 as Instrument No. YR232750 but never conveyed Block 13, Plan 65M-2668 back to Stringbridge Investments Limited.

 

Block 13, Plan 65M-2668 (See Appendix 3) is currently used by Stringbridge Investments Limited as part of its driveway and the reconveyance to Stringbridge Investments Limited will have no impact on the traffic operations of Clegg Road.
