SUBJECT:                          Town Conveyance of a Portion of New Delhi Drive

                                            to the Region of York

RECOMMENDATION:

THAT the report entitled “Town Conveyance of a portion of New Delhi Drive to the Region of York” be received;

 

THAT Part of Lot 3, Concession 8, designated as Parts 1 and 4, Plan 65R-29254 be declared surplus pursuant to Town of Markham By-law 178-96 and that notice of the proposed disposition of such lands be placed on the agenda for the Council meeting of June 12, 2007;

 

AND THAT a by-law be enacted at Council on June 12, 2007, authorizing the Mayor and Clerk to execute a Transfer of Land in favour of the Region of York for nominal consideration and other related documents for the completion of this transaction, all in a form satisfactory to the Town Solicitor.

 

AND THAT Staff be authorized and directed to do all things necessary including execution of documents to give effect to this report.

PURPOSE:


The purpose of this report is to obtain Council authority to convey a daylighting triangle/road throat at the intersection of New Delhi Drive and Markham Road to the Region of York.

 

 

BACKGROUND:


Council at its meeting of April 11, 2006, authorized the purchase from Forest Bay Homes Ltd. of lands required to extend Golden Avenue into the development on the east side of Markham Road for a purchase price of $500,000.00.  Costco/Trinity Developments funded $250,000.00 of this purchase and the Town paid the remaining $250,000.00.  This transaction was closed on September 22, 2006.  That road has since been named New Delhi Drive.  This road serves both the Costco subdivision and the Town lands acquired for the future South East Community Centre.

 

The Town’s Engineering Department has been advised by the Region of York that Part 1 comprising the daylighting triangle/road throat and Part 4 being a 0.3m reserve needs to be conveyed to the Region of York to form part of Markham Road (Highway 48) road allowance maintained by the Region.  The Town will retain Part 2, being the balance of New Delhi Drive and Part 3, being the 0.3m reserve along the entire length of Part 2.  Attached to this report is a reduced copy of Plan 65R-29254 for your reference.

 

This report recommends the conveyance for nominal consideration.  The lands will remain road, however jurisdiction for that part of the road will be transferred to the Region.
