SUBJECT:                          Cerswell Avenue Stop-Up and Close

RECOMMENDATION:

THAT by-law be enacted to stop-up and close Cerswell Avenue on RP 2368, more particularly described as a portion of  RCP 9766 LOT 15 RCP 9767 LOT 56 EXP PLAN 7696 PART 1, Town of Markham, Regional Municipality of York.

PURPOSE:

The purpose of this report is to obtain the necessary Council approvals and to enact the necessary by-laws to stop up and close Cerswell Avenue.

 

BACKGROUND:

On January 5, 1923 Cerswell Avenue was dedicated as a public road on Registered Plan 2368.

 

The road was expropriated by the Public School Board for use as part of an elementary school site on December 22, 1960. The road was not stopped up and closed by the Town prior to its expropriation.

 

OPTIONS/ DISCUSSION:

The Engineering Department has advised that the Cerswell Avenue is not functioning as a public right of way and is currently used as a private driveway servicing the existing E.J. Sand Elementary School located at 160 Henderson Avenue. Accordingly, a By-law to stop up and close the former road should be enacted and registered on title.

The Town’s Engineering Department has requested the stop-up and close of Cerswell Avenue. The Development Services Committee approved the stop-up and close of Cerswell Avenue on May 7, 2002.
