SUBJECT:                          Liquor Licence Application Process

RECOMMENDATION:

That the Town of Markham lodge an objection to the following applications for liquor licences:

 

                                  Club Rio8261 Woodbine Avenue, Units 8 to 11

                                  Pixel 8 Lounge – 50 Bur Oak Avenue, Unit C-8

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

To facilitate York Region Police Services input into two separate liquor licence applications.

 

BACKGROUND:

The Town of Markham, unlike any other municipality in Ontario, circulates applications for liquor licences to Building, Fire, and By-Law Enforcement.  In other municipalities, applicants are required to obtain their own separate approvals.  The Alcohol and Gaming Commission (ACGO) make their own arrangements for police clearance through the Ontario Provincial Police (OPP).  The application process does not include contact with local police services rather that occurs through the ACGO Enforcement Branch.

 

On May 10th, 2007, municipal clearance was given for the liquor licence at Club Rio, following the routine process for applications.  Similarly, on August 3rd, municipal clearance was given for the liquor licence at Pixel 8 Lounge, also following the routine process for applications.

 

Subsequent to both approvals, the writer was contacted by York Region Police expressing concerns with respect to both locations.  Contact with the ACGO was made immediately and they advised that the applications were still being processed and that

approval of either licence had not been granted at this time.  They also confirmed that a Council resolution officially objecting to the licence being issued is required to defer approval.  Letters respecting both locations were forwarded to the ACGO requesting a delay in the approval process until mid September until a Council resolution could be obtained.  That request has been granted.

 

OPTIONS/ DISCUSSION:

A Council resolution is required in order for York Region Police to be able to express their concerns as they relate to the two locations that are the subject of applications for liquor licences.

 

In the future, circulation of applications will include York Region Police Services.  That will eliminate situations where the Town has granted municipal clearance in advance of York Region Police being aware of the application.
