THAT the report entitled “3-Stream Design Requirement For Medium And High Density Residential Development And Re-Development” be received,

 

AND THAT Council endorse the 3-Stream design provisions in Attachment ‘A’ and the transition guidelines included in this report,

 

AND THAT Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

To seek endorsement of the recommended 3-Stream waste separatation design provisions and transition guidelines for medium and high density residential development and redevelopment.

 

 

BACKGROUND:

Markham’s award winning diversion program has a goal to divert 75% of waste from landfill.  In order to achieve this target, 3-stream collection needs to be expanded to the high-rise rental and condominium multi-residential sector.

 

The main barrier to increased diversion in this sector is the unlimited, convenient access to waste disposal that traditional garbage chutes represent and limited access to recycling in buildings that were not originally designed to support a recycling program.

 

In 2005, the Town’s high-rise multi-residential diversion rate was 17%.  This already compared favorably to the 12-13% diversion rates in most other Canadian cities.

 

In 2006, Markham expanded the multi-residential recycling program, addressed property management issues, and improved education which increased the multi-residential diversion rate to 22%. Markham currently has the highest multi-residential diversion rate in Canada.

 

The next step involves providing organics collection to Markham’s high-rise multi-residential sector.  This will be accomplished with a two-stage strategy. 

 

The first stage is the phased introduction of organics collection to the 52 buildings Markham currently services.  Introducing organics collection to existing buildings must be phased because retrofitting this service into buildings that were not designed for recycling must be done on a building-by-building basis.  One building received organics collection in 2007 on a pilot basis.  Ten buildings will receive organics collection in 2008 and the balance will receive organics collection in 2009 and 2010.

 

The second stage is to update Markham’s waste management site plan control agreement conditions for all future high-rise residential development applications.  This will ensure that all future high-rise residential buildings will be built to include 3-stream collection systems.  The proposed conditions are attached to this report.

 

 

OPTIONS/ DISCUSSION:

York Region Servicing Allocation Supports 3-Stream System 

In June 2007 York Region directed Regional staff to implement a program, in consultation with the Local Municipalities, to provide a 20% to 35% increase in water and sewer allocation for high density residential developments meeting certain eligibility criteria.  The established criteria includes, among others, a minimum five storey height requirement and a proposed minimum LEED Silver certification.  Once the project is confirmed eligible by satisfying the initial qualifying criteria, the applicant must commit to constructing a development that meets certain ‘Sustainability Objectives’ including the incorporation of a 3-Stream collection system.

 

In February 2008, Council passed a resolution supporting the above Regional policy in order to maximize the Town’s servicing allocation while promoting energy efficient, LEED certified high density buildings with high waste diversion rates.

 

Acceptable 3-stream collection systems include the following;

·         Single chute systems with tri-sorting equipment and lock-out chute doors

·         Dual chute systems with bi-sorting equipment on one chute and lock-out chute doors on the bi-sorted chute

·         Triple chute systems

·         Recycling rooms with no chutes (for smaller buildings)

 

New building designs with single chute waste collection systems that require residents to go to centralized refuse storage room to dispose of recyclables and organics is not acceptable.

 

Transition guidelines

In a March 18, 2008 report to Development Services Committee staff proposed development of Sustainable Development Standards and Guidelines as well as Interim Sustainability Measures.  At that time staff also outlined reasonable transition guidelines that should apply to interim sustainability measures.  It is recommended that similar transition guidelines be applied when requiring 3- stream collection systems, to ensure that the process of discussion, education and acceptance continue.  The proposed guidelines for medium and high density residential site plan approval applications are as follows:

 

·        Applications that are in process, but not yet site plan endorsed should comply, unless compelling reasons or hardship can be demonstrated;

·        Applications that are in process that are endorsed, but not yet site plan approved should comply to the extent possible.  Compliance will depend on the status of building permit drawings and contractual arrangements with suppliers and tenants/purchasers;

·        Applications that have received site plan approval shall proceed as approved unless the applicant is willing to participate in the program;

·        All new, incoming applications will comply.

 

Acceptable 3-stream collection systems and the above transition guidelines were presented to the industry through the Developers Round Table meeting held on April 2, 2008.  No objections or concerns were raised at that meeting regarding this matter.

ENVIRONMENTAL CONSIDERATIONS:

Implementing measures that ensure maximum diversion in Markham’s multi-residential high-rise developments is consistent with the Town’s Environmental Focus and Mission Green goal to divert 75% of waste from landfill by ensuring that all residential buildings offer their residents accessibility to recycling, organic waste and residual waste collection services.

ENGAGE 21ST CONSIDERATIONS:

Implementing measures that ensure maximized waste diversion in Markham’s multi-residential high-rise developments is consistent with Markham’s Corporate Goals of Managed Growth, Infrastructure Management, and Quality Community.

Waste Management Site Plan Control Agreement Conditions for High-Rise Residential Developments

 

1.      The Owner acknowledges that all waste, recyclable and organic materials will be collected by the Town.

 

2.   The Owner covenants and agrees to provide 3-Stream sorting and collection system for organics, recyclable materials and residual waste as required by the Town.

 

Acceptable 3-stream collection systems include the following;

·         Single chute systems with tri-sorting equipment and lock-out chute doors

·         Dual chute systems with bi-sorting equipment on one chute and lock-out chute doors on the bi-sorted chute

·         Triple chute systems

·         Recycling rooms with no chutes (for smaller buildings)

 

3.   The owner covenants and agrees to design and construct internal material storage room(s) with sufficient space to store source, recyclable materials and residual waste for a minimum of one week.

 

4.   The Town covenants and agrees to provide assistance to the Owner in determining location and space requirements which will be in accordance with the Ontario Building Code and the Fire Safety Code as they pertain to multi-residential refuse collection systems and refuse storage rooms.

 

5.      The Owner covenants and agrees to purchase from the Town one (1) in unit recycling container and one (1) organics kitchen collector unit per dwelling unit so that each resident may participate in the Town’s 3-Stream program.  Furthermore, the Owner shall ensure that the in unit recycling containers, kitchen collectors and educational materials are deposited in each dwelling unit on or before the date of closing or tenant occupancy.

 

6.      The Owner agrees to contact the Town at least four weeks prior to unit occupancy to arrange an appointment time at which the in unit recycling containers, kitchen collectors, and educational materials are to be collected by the Owner from the Town at a location determined by the Town.

 

7.      The Owner agrees to pay to the Town the cost for the in unit recycling containers and kitchen collectors as outlined in Schedule “D” to this Agreement and to provide said recycling containers and organics kitchen collectors to the residents at the same cost as paid to the Town.

 

8.      The Town covenants and agrees to provide, at no cost to the Owner, all educational materials necessary to enable the residents to participate in the Town’s waste diversion program.

 

9.      The Owner shall:

a.             ensure that there will be absolutely no external storage of waste, recyclable, or organic materials.

b.            ensure that all waste, recycling and organics containers are placed out at the time of collection and returned to the refuse storage room(s) immediately following collection, and that the doors to the refuse storage room(s) remain closed at all times other than at time of collection;

c.             be solely responsible for site maintenance in order to maintain an acceptable level of appearance with regard to waste management practices;

 

10.  Where the Owner has retained a management company to carry out the duties outlined in Section 9 the Owner shall remain responsible for those duties and will monitor and supervise the management company so as to ensure that all duties are performed in a timely and proper fashion.
