RECOMMENDATION:

That the report dated May 20, 2008, entitled “Preliminary Report, Estee Lauder Cosmetics, 80 Alden Road, Official Plan and Zoning By-law Amendment applications to permit a parking lot within the Hydro Corridor, (OP 08 112499 & ZA 08 112500)”, be received;

 

And that staff be authorized to schedule a Public Meeting to consider the Official Plan and Zoning By-law Amendment applications;

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

Subject lands and area context

The portion of the Hydro Corridor lands which is the subject of these applications is municipally known as 80 Alden Road (the “subject lands”) and is bounded by the CN Rail line to the north, Alden Road to the south and the Estee Lauder Cosmetics building at 100 Alden Road to the immediate east.  Industrial buildings surround the lands (Figure 3).

 

Proposal for a parking lot within the Hydro Corridor

Estee Lauder Cosmetics conducts their warehousing and storage operations at 100 Alden Road which abuts the subject lands to the east. Currently there are 173 parking spaces at 100 Alden Road. Estee Lauder Cosmetics is proposing to expand their parking lot and add 86 parking spaces within the abutting Hydro Corridor lands. Estee Lauder Cosmetics employs 250 people working three overlapping shifts which run 24 hours, 6 days a week. The proposed parking lot will have a depth of approximately 101 metres (331 feet) extending from the CN Rail Line, and a width of approximately 31 metres (101 feet) (Figure 4). The proposed parking area will be used solely by employees of Estee Lauder Cosmetics at 100 Alden Road.

 

Official Plan

80 Alden Road is designated Transportation and Utilities in the Town’s Official Plan. The principal use of land shall be for major transportation and utility corridors and facilities including highways, railways, hydro electric transmission, gas and oil pipelines, telephone and other cabled services and airports. Those lands used for electric power transmission facilities, such as the subject lands, may also be used for “other uses satisfactory to Ontario Hydro and compatible with adjacent land uses, subject to approval of an amendment to this plan.” The proposed parking area is compatible with the adjacent industrial land uses and abutting CN Rail line. An amendment to the Official Plan is required to add a parking area as a site-specific permitted use. The Transportation and Utilities designation will remain.

 

Zoning

80 Alden Road and the surrounding area is zoned Select Industrial with Controlled Storage – M(CS) in By-law 108-81, as amended (Figure 2). The By-law permits a parking area to be located only on the same lot which it is intended to serve. A By-law amendment is required to permit a parking lot as a stand alone use on the Hydro Corridor lands which will serve the abutting property. The additional parking is surplus and not required parking under the by-law.

 

 


OPTIONS/ DISCUSSION:

Approval required from Ontario Realty Corporation and Hydro One

80 Alden Road is owned by Her Majesty the Queen in Right of Ontario and represented by the Ontario Realty Corporation (ORC). Hydro One Networks (Hydro One) operates the Hydro Corridor. The proposed development requires approval from both ORC and Hydro One and these applications have been circulated to both agencies. The applicant has been in consultation with both agencies and has provided the proposed site plan and other technical plans for review prior to submitting these applications. The Town is in receipt of authorization from ORC allowing these applications to be submitted and reviewed by the Town.

 

ORC is generally agreeable to the proposed development and the applicant is in the process of finalizing a lease agreement with them. Hydro One is reviewing the landscape plan, site servicing and grading plan and stormwater management report which all must comply with their standards. Approval of all of the aforementioned plans is required from ORC and Hydro One prior to the issuance of site plan approval. Town staff and the applicant met with representatives from both agencies and they appear to be generally agreeable to the proposal subject to approval of the technical plans and lease agreement.

 

CN Rail has no objections to the proposed parking area

The subject lands abut the Canadian National Railway Line (CN) to the north and these applications have been circulated to CN. The applicant consulted with CN Rail prior to submitting this application, specifically with respect to stormwater runoff from the proposed parking lot to the Railway property. CN has reviewed the proposal and the stormwater calculations and has provided a letter indicating that they have no objections to the proposed construction as it appears that the impact to the Railway property is minimal.

 

Site Plan application and technical studies have been submitted

The applicant has submitted a site plan application and technical studies, including a landscape plan, site servicing plan, grading plan, Subsurface Environmental Study and stormwater management report. The site plan application is currently under review and will enable the Town to ensure that the proposed parking area is appropriately designed and screened from adjacent land uses. The Engineering Department has reviewed the engineering submissions and find them to be acceptable. The landscape plan is still under review. Approval of the site plan is required from ORC and Hydro One. Town staff have delegated approval authority for the site plan application.





ENVIRONMENTAL CONSIDERATIONS:

The applicant has submitted a Subsurface Environmental Study which is currently under review.

 

ACCESSIBILITY CONSIDERATIONS:

None at this time.

 

ENGAGE 21ST CONSIDERATIONS:

The proposed development makes use of the Hydro Corridor lands and minimizes the need to use other developable lands for parking purposes.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

All Town departments and agencies have been circulated with these applications and all comments will be considered during the site plan process.

 

 

 

 

CONCLUSION

Estee Lauder is an important business in the Town and employs 250 people. The success of this business has mandated the need for multiple overlapping shifts. To accommodate the needs of the employees, Estee Lauder is seeking to expand their parking operations into the adjacent Hydro Corridor. The proposal has been designed to minimize the impacts on adjacent operations, including the rail line. ORC, Hydro One and Town staff have been in consultation with the applicant prior to these applications having been submitted. Specific site plan and landscape issues will be addressed during the site plan process.
