The Manager of Heritage Planning introduced this item, and explained that the Committee of Adjustment requires the benefit of Heritage Markham’s recommendation this same evening.
The proposal is to sever a parcel of land with one existing dwelling, into two lots. The owner is also trying to obtain additional land from the road allowance to further enhance the parcel size. A building demolition permit has been approved, and staff are working with the applicant on tree preservation issues. Staff can support the application, with conditions. The property is subject to site plan control, therefore Heritage Markham will have an opportunity to comment at later stages.
Mac Cosburn, representing the applicant, supported the staff report and recommendation.
HERITAGE
THAT Heritage Markham has no objection to

The Senior Heritage Planner explained the preservation and relocation of the Mapes House is a condition of a Subdivision Agreement.
David Stewart, representing the applicant, Box Grove Hill Developments, advised that following evaluation, it is their belief that relocation and restoration is not viable as the building is not structurally sound. In light of the substantial contributions the developer has made to the community, including restoration and relocation of two other Heritage buildings, the applicant is requesting that a replica building be permitted instead.
Mr. Stewart suggested that the building would be disassembled, and reassembled at the new location, salvaging what can be used. All features identified in the Heritage Easement Agreement – such as the existing windows - can be preserved and used in construction of the replica structure. The shingles, sofit and facia, foundation, siding, verandah and other aspects are already going to be replaced, so in their opinion, there is not much left of the original house.
Mr. Stewart stated that in 2004, the structural engineer deemed that the building was not sound, and assessed that almost total reconstruction would be required. There is extensive rot in the floor structure and new electrical and plumbing systems have to be installed. In 2008, an Architect identified extreme Building Code deficiencies and concluded that the only option is to demolish the building.
Mr. Stewart advised that Danco House Movers would not accept responsibility for any accidents while moving the structure, and Mr. Stewart put the Town on notice that the applicant also could not accept responsibility for any accidents. The applicant had not consulted an alternate mover, as was suggested by the Committee.
Staff argued that in comparison to the condition of other buildings that have been relocated and restored, the house could be sufficiently repaired prior to moving it.
The Committee acknowledged the professional opinion of the engineer, and the good record of this developer. It was also noted that the condition of the structure is typical to untenanted houses, but that all the issues, such as the floor joists and the ceiling over the stairs, are repairable. With respect to the Building Code, it was clarified that although the Code would not apply to modifications to the heritage structure, Mr. Stewart stated that the Chief Building Official has safety concerns for the low configuration of the ceiling at the top of the stairs.
Mr. Stewart responded that there has been no market interest in the
building in four years, and he confirmed that the house had been boarded up, as
required, but has been broken into over the years. Heritage

The Senior Heritage Planner explained that the brick house, dating from the 1850s, is listed in the Register. Following discussions, the applicant has agreed to withdraw the demolition permit on the main house and will only demolish the modern rear wing and the barn, subject to offering the barn for relocation or salvage. In view of this agreement, the designation of the house is no longer urgent.
Jim Kirk, representing the applicant, 404/19th Avenue Developments, confirmed staff’s comments, and stated that it is their understanding that structural engineers will assess the building prior to demolishing the frame part of the house, and that it will be boarded up as required.

WINDOW REPLACEMENT

The Senior Heritage Planner explained that the applicant has applied for a Heritage Permit for work already performed on the building, in which Heritage windows were replaced without approval. Staff displayed photographs and noted that the new windows do not fit properly with respect to the sills.
Mr. Halligan, applicant, admitted that he
had neglected to get a permit, and explained that the old windows were rotting and
did not function properly, so they were replaced with new windows that are more
energy efficient, better noise barriers, and easier to clean. The new windows
were installed professionally and have been primed in a neutral colour. Mr. Halligan advised that he had always
renovated to the required standards in the past, but in this case, in his
opinion, the original windows were not repairable.
Committee members stated that heritage/original windows are a very important feature and that staff had previously advised the owner that the original windows could be restored. It was stated that adequate storms could have been obtained so that with proper retrofitting, the difference in R-value between the old and new windows would be negligible. The mandate of this Committee is to preserve heritage, and this is an issue that has been discussed with many applicants. It was noted that although the windows appear compatible, it sets an undesirable precedent if the applicant goes ahead with renovations without approval. A comment was made by the Committee that consideration should be given to health, air flow, and warmth factors.

The Senior Heritage Planner introduced this matter, advising that the Ontario Farm House is to be relocated as part of a subdivision block. The mover considers the brick veneer to be unstable, and would like to remove the brick and rebrick the walls after the building has been relocated.
Mr. Larkin, the applicant, advised that he has been moving and restoring houses for 30 years. He explained that the wood nailing strip over the front porch is rotting, the porch has to be replaced, and the back wall of the building, which currently has an addition attached, will have to be bricked once it is relocated. He displayed photographs of other re-bricking projects he has completed, as well as photographs of the subject building, showing the condition of the bricks. Approximately 30% of the bricks are damaged.
Staff suggested the repairs could be made to
stabilize the bricks prior to moving the structure. The Committee acknowledged
that there appeared to be many cracks. Staff suggested a report be obtained
from a mason or an expert Heritage brickwork company prior to considering the
removal of all bricks. The Committee agreed that Mr. Larkin is an expert in
this field, and accepted his opinion.

Liz Wimmer, Senior Planner, Urban Design, gave a presentation on the Main Street Unionville Streetscape Study, initiated in 2005 for the Unionville Heritage Conservation District as a result of the 2004 Environmental Assessment.
Ms. Wimmer reviewed the context, public consultation process, and findings of the study. Three options were presented to the public. The preferred option involves minimal parking spaces (12), to optimize greening and public spaces. Council has approved the proposal, and the details are now being finalized.
