The Manager of Heritage Planning introduced this item, and explained that the Committee of Adjustment requires the benefit of Heritage Markham’s recommendation this same evening.

 

The proposal is to sever a parcel of land with one existing dwelling, into two lots. The owner is also trying to obtain additional land from the road allowance to further enhance the parcel size. A building demolition permit has been approved, and staff are working with the applicant on tree preservation issues. Staff can support the application, with conditions. The property is subject to site plan control, therefore Heritage Markham will have an opportunity to comment at later stages.

 

Mac Cosburn, representing the applicant, supported the staff report and recommendation.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham has no objection to Committee of Adjustment application B/19/01subject to the retention of as much mature vegetation on the property as possible and the applicant not removing any trees/vegetation without prior approval of the Town.

The Senior Heritage Planner explained the preservation and relocation of the Mapes House is a condition of a Subdivision Agreement.

 

David Stewart, representing the applicant, Box Grove Hill Developments, advised that following evaluation, it is their belief that relocation and restoration is not viable as the building is not structurally sound. In light of the substantial contributions the developer has made to the community, including restoration and relocation of two other Heritage buildings, the applicant is requesting that a replica building be permitted instead.

 

Mr. Stewart suggested that the building would be disassembled, and reassembled at the new location, salvaging what can be used. All features identified in the Heritage Easement Agreement – such as the existing windows - can be preserved and used in construction of the replica structure. The shingles, sofit and facia, foundation, siding, verandah and other aspects are already going to be replaced, so in their opinion, there is not much left of the original house.

 

Mr. Stewart stated that in 2004, the structural engineer deemed that the building was not sound, and assessed that almost total reconstruction would be required. There is extensive rot in the floor structure and new electrical and plumbing systems have to be installed. In 2008, an Architect identified extreme Building Code deficiencies and concluded that the only option is to demolish the building. 

 

Mr. Stewart advised that Danco House Movers would not accept responsibility for any accidents while moving the structure, and Mr. Stewart put the Town on notice that the applicant also could not accept responsibility for any accidents. The applicant had not consulted an alternate mover, as was suggested by the Committee.

 

Staff argued that in comparison to the condition of other buildings that have been relocated and restored, the house could be sufficiently repaired prior to moving it.

 

The Committee acknowledged the professional opinion of the engineer, and the good record of this developer. It was also noted that the condition of the structure is typical to untenanted houses, but that all the issues, such as the floor joists and the ceiling over the stairs, are repairable. With respect to the Building Code, it was clarified that although the Code would not apply to modifications to the heritage structure, Mr. Stewart stated that the Chief Building Official has safety concerns for the low configuration of the ceiling at the top of the stairs.   

 

Mr. Stewart responded that there has been no market interest in the building in four years, and he confirmed that the house had been boarded up, as required, but has been broken into over the years. Heritage Markham confirmed its support for the recommendation of the Architectural Review Sub-Committee.  

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham recommends that the John Mapes House be relocated to its intended site at 6888 Fourteenth Avenue, and restored as per the requirements of the Subdivision Agreement;

 

AND THAT prior to relocation, the applicant should undertake any structural problems that need to be addressed to enable the building to be moved safely;

 

AND THAT Heritage Markham has no objection to the applicant carrying out modifications to the interior layout, stair location, ceiling framing and mechanical systems in order to update the interior for current living.

THAT
Heritage Markham has no objection to the overall form and footprint of the proposed addition to 30 Wales Avenue;

 

AND THAT Heritage Markham recommends that the addition be finished in a cladding different from the original cladding of the house, once it has been determined, to better distinguish the addition from the original portions of the house;

 

AND THAT Heritage Markham recommends that the veranda be remodelled to replicate a typical Markham area Edwardian veranda that includes simple wooden columns and an appropriate railing;

 

AND THAT any height increase related to the new basement foundation be limited to one foot in height from the existing condition;

 

AND THAT final approval of any Site Plan application for 30 Wales Avenue be delegated to Heritage Section Staff provided that the proposed addition is generally the same as what has been reviewed by Heritage Markham.

The Senior Heritage Planner explained that the brick house, dating from the 1850s, is listed in the Register. Following discussions, the applicant has agreed to withdraw the demolition permit on the main house and will only demolish the modern rear wing and the barn, subject to offering the barn for relocation or salvage. In view of this agreement, the designation of the house is no longer urgent.

 

Jim Kirk, representing the applicant, 404/19th Avenue Developments, confirmed staff’s comments, and stated that it is their understanding that structural engineers will assess the building prior to demolishing the frame part of the house, and that it will be boarded up as required. 

 

HERITAGE MARKHAM RECOMMENDS:

           
IN VIEW of the fact that the applicant has withdrawn the demolition permit for the Alfred Read House, and will allow heritage conservation issues to be dealt with in the context of a future development application;

 

THAT Heritage Markham has no objection to the demolition of the barn and rear wing of the house at 2780 19th Avenue, subject to the barn being advertised for relocation or salvage and the applicant boarding up the house and repairing the hole in the roof;

 

AND THAT staff prepare a research report on the heritage value of the Alfred Read house at 2780 19th Avenue.

The Senior Heritage Planner explained that the applicant has applied for a Heritage Permit for work already performed on the building, in which Heritage windows were replaced without approval. Staff displayed photographs and noted that the new windows do not fit properly with respect to the sills.

 

Mr. Halligan, applicant, admitted that he had neglected to get a permit, and explained that the old windows were rotting and did not function properly, so they were replaced with new windows that are more energy efficient, better noise barriers, and easier to clean. The new windows were installed professionally and have been primed in a neutral colour.  Mr. Halligan advised that he had always renovated to the required standards in the past, but in this case, in his opinion, the original windows were not repairable. 

 

Committee members stated that heritage/original windows are a very important feature and that staff had previously advised the owner that the original windows could be restored. It was stated that adequate storms could have been obtained so that with proper retrofitting, the difference in R-value between the old and new windows would be negligible. The mandate of this Committee is to preserve heritage, and this is an issue that has been discussed with many applicants. It was noted that although the windows appear compatible, it sets an undesirable precedent if the applicant goes ahead with renovations without approval. A comment was made by the Committee that consideration should be given to health, air flow, and warmth factors.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham does not support the Heritage Permit for the installation of the new wooden windows at 28 John St. because the original wooden heritage windows were capable of being restored and the new windows are not properly fitted to the windows openings of the heritage house;

AND THAT Heritage Markham supports the Town’s pressing of charges on the owner of 28 John St. for the unauthorized alteration of the exterior of a heritage building designated under Part V of the Ontario Heritage Act.

The Senior Heritage Planner introduced this matter, advising that the Ontario Farm House is to be relocated as part of a subdivision block. The mover considers the brick veneer to be unstable, and would like to remove the brick and rebrick the walls after the building has been relocated.

 

Mr. Larkin, the applicant, advised that he has been moving and restoring houses for 30 years. He explained that the wood nailing strip over the front porch is rotting, the porch has to be replaced, and the back wall of the building, which currently has an addition attached, will have to be bricked once it is relocated. He displayed photographs of other re-bricking projects he has completed, as well as photographs of the subject building, showing the condition of the bricks. Approximately 30% of the bricks are damaged.

 

Staff suggested the repairs could be made to stabilize the bricks prior to moving the structure. The Committee acknowledged that there appeared to be many cracks. Staff suggested a report be obtained from a mason or an expert Heritage brickwork company prior to considering the removal of all bricks. The Committee agreed that Mr. Larkin is an expert in this field, and accepted his opinion.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham accepts the applicant’s proposal for disassembling and reassembling of the brickwork during relocation of the Jonathan Gowland House at 9486 McCowan Road.

Liz Wimmer, Senior Planner, Urban Design, gave a presentation on the Main Street Unionville Streetscape Study, initiated in 2005 for the Unionville Heritage Conservation District as a result of the 2004 Environmental Assessment.

 

Ms. Wimmer reviewed the context, public consultation process, and findings of the study. Three options were presented to the public. The preferred option involves minimal parking spaces (12), to optimize greening and public spaces. Council has approved the proposal, and the details are now being finalized.

 

Proposed plantings and heritage fixtures were displayed. One outstanding issue relates to the light fixtures on the east side of Main Street. Due to the location of the hydro lines, the fixtures will have to be mounted on hydro poles, or eliminated. Colours will also need to be determined. The Committee requested that staff bring design samples to a future meeting for review.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT the presentation by Elizabeth Wimmer, Senior Planner, Urban Design, be received;

 

AND THAT Heritage Markham has no objection to the proposed streetscape infrastructure improvements from a heritage perspective;

 

AND THAT staff report back on the street light issue;

The Heritage Planner advised that the preliminary drawings for this application had been before the Committee in August, 2008 and the Architectural Review Sub-Committee had made recommendations regarding the design and orientation of the building. The applicant now requests that the Committee consider revised drawings. Staff agree that the design, detailing, and proportion of the proposed addition have improved. It was recommended by the Committee that the proposal go forward to the Architectural Review Sub-Committee, and return to Heritage Markham for final approval.

 

Halla Palabiski, applicant, requested the matter be dealt with as soon as possible.

The Heritage Planner advised that the applicant is requesting support in relocating the building to Markham’s Heritage Estates.

 

The Committee agreed that there are enough threatened Heritage building within the Town of Markham to fill the lots at Heritage Estates. In order to avoid any unnecessary expense to the applicant, the Committee could not support authorizing staff to start the process of researching the building. The Committee had previously suggested that Stouffville needs to deal with its own houses.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham not support the relocation of the Phillip Bartholomew House from Stouffville, and recommends staff not take any further action.

The Heritage Planner introduced this application for an addition to a Class B structure and described the changes to the pitch of the roof, and the design, which is generally complementary to the area.

 

HERITAGE MARKHAM RECOMMENDS:

 

THAT Heritage Markham is generally supportive of the proposed design concept for the additions and remodelling of 23 Church Street;

 

AND THAT the preliminary design concept be forwarded to the Architectural Review Sub-Committee with authority to approve on behalf of Heritage Markham;

 

AND THAT the future Site Plan application to the Town contain the usual provisions regarding materials, colours, and windows, etc.;

 

AND THAT final approval of any future Site Plan application for 23 Church Street be delegated to Heritage Section staff provided that the design proposal is not significantly different from the one reviewed by Heritage Markham/Architectural Review Sub-Committee.

AND THAT the owner of 275 Markham Main St. N. enter into a Site Plan Agreement with the Town containing the usual provisions regarding windows, materials, colours, etc.;

 

AND THAT final approval of any Site Plan application for the garage at 275 Markham Main St. N. be delegated to Heritage Staff subject to the recommendation of the Architectural Review Sub-Committee.
