Pesticide By-law Licencing Checklist
1. Application for Licence:
Completed application
Applicable fee payment
Prior to December 31st
Copy of Articles of
Incorporation (applies to corporate applicants)
List of partner names
and addresses (applies to partnerships)
Copy of Ontario’s
Master Business Licence
Proof of current pesticide
operator licence and pesticide exterminator licence (Pesticide Applicators
only)
List of employees (who
provide pesticide free lawn care services)
List of pesticide-free
lawn care services provided
Advertising samples
Other relevant
information
All changes to the
above mentioned particulars must be reported to the Licensing Officer within
seven days
2. Nature of Licence:
Expires December 31st
Licence not to be
transferred, sold, leased, subleased, rented or assigned to any other person
Licence to be returned
to the Town upon revocation, suspension, or non-renewal
3. Regulations:
Compliance with all
Federal and Provincial laws, including Markham By-laws as amended
Application to be
submitted prior to the pesticide being applied (Pesticide Applicators only)
4. Prohibitions:
No person shall carry
on the business of an Applicator in the Town without a Town licence
5. Role of Licensing Officer:
Receive and process all
applications for licenses and renewal of licenses to be issued under this
by-law
Issue and renew
licenses for persons who meet the requirements of this by-law
Perform all the
administrative functions of this by-law
Coordinate the
enforcement of this by-law
6. Council Direction:
Seek Council’s
direction with respect to renewal/ revocation of a licences not meeting terms
of by-law
7. Offence, Penalty & Enforcement:
Licensees must produce
the licence upon request of any person authorized to enforce by-law
Licensees must allow
for the inspection of, equipment and vehicles
No person shall hinder
or obstruct any person authorized to enforce the By-law
Fines for
contravention:

Person: not to exceed $25,000/Corporation:
not to exceed $50,000

8. Inspection
Officers are permitted
to verify contents of materials being used to ensure by-law compliance
