SUBJECT:                          Parking Control By-Law – Administrative Amendment

RECOMMENDATION:

That By-Law 2005-188, “A By-Law to Govern and Control Parking of Vehicles in the Town of Markham”, be amended to state that no person shall park a motor vehicle so as to obstruct any portion of a sidewalk;

 

And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

To facilitate a technical change to the Parking Control By-Law to assist Officers both in the field and when matters are advanced through the courts. 

 

BACKGROUND:

On January 14, 2008, a report was presented to Committee recommending three administrative amendments.  Two amendments were approved but the third recommending an administrative change in Section 5 (e) that would eliminate the opportunity to openly interpret what qualifies as an obstruction to a sidewalk was deferred to staff for further review.

 

OPTIONS/ DISCUSSION:

Staff met with Deputy Mayor Heath and Councillor Shapero to discuss the proposed amendment.  Staff confirmed that the change is technical in nature and no change to the enforcement protocols is anticipated.  Staff consider this tightening up of the by-law to be consistent with two other Town-wide initiatives: the first being the Extended Driveway Program designed to reduce front yard parking, and second the proposed Second Suites initiative, a component of which would be proper enforcement of parking in neighbourhoods, and no streetscape changes as a result of its implementation.
