SUBJECT:                          Satellite Recreation Centre Policies Agreement Amendment

RECOMMENDATION:

THAT the report titled “Satellite Recreation Centre Policies Agreement Amendment” be received;

 

AND THAT authorization is given to amend the “Satellite Recreation Centre Policies Agreement” to reflect that the maintenance and replacement of the playground equipment at the German Mills Community Centre be the sole responsibility of the Town of Markham;

 

AND THAT authorization is given to the German Mills Board to amend their lease with the German Mills Co-operative Nursery School to reflect the amendment in the “Satellite Recreation Centre Policies Agreement”;

 

AND THAT Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to obtain authority to amend the current “Satellite Recreation Centre Policies Agreement” to reflect the maintenance and replacement of the playground equipment at the German Mills Community Centre as being the sole responsibility of the Town of Markham.   The report also requests permission for the German Mills Board to amend their existing lease agreement with the German Mills Co-operative Nursery School to reflect the amendment to the “Satellite Recreation Centre Policies Agreement”.

 

BACKGROUND:

The existing “Satellite Recreation Centre Policies Agreement” was adopted by Council at its meeting held April 11, 2006.  The “Facility Maintenance Policy” within the Agreement, under Section IV, subsection 7.0 for Grounds Maintenance, requires modification to the paragraph relating to the playground equipment in order to clarify that the Town of Markham is fully responsible for the playground equipment located in the public park at the German Mills Community Centre.

 

Asset Management are also requesting that the German Mills Board be given permission to amend their lease agreement with the German Mills Co-operative Nursery School, section seven (7) to delete the responsibility for the Nursery School to maintain the “Outdoor Play Equipment”.

 

 

 

 

OPTIONS/ DISCUSSION:

Under the current situation, the German Mills Co-operative Nursery School is responsible to maintain the playground equipment to all codes and standards having jurisdiction while the Town of Markham is responsible for the sand safety surfaces under the equipment.

In discussions with our insurance provider, Cowan Insurance, and our Legal Department, it was decided that this split responsibility was not a good situation from a risk management standpoint.

Therefore, it is recommended to alter both the “Satellite Recreation Centre Policies Agreement” and the German Mills Co-operative Nursery School lease to reflect the change in the playground responsibilities.

 

FINANCIAL CONSIDERATIONS AND TEMPLATE: (external link)

The Parks division of the Operations Department will have to budget for replacement over the life cycle of the playground.  The playground equipment is approximately 11 years old and, as the equipment has been maintained to meet all codes and standards over it’s lifespan, it is in good condition.  The equipment will be added to the life cycle database with anticipated costs to the Town, over the next 10 years, of approximately $10,000 to $15,000.
