RECOMMENDATION:
1) That
the report entitled “Recommendation Report, Wismer Markham Developments Inc.,
South of Major Mackenzie Drive, west of Highway 48, Wismer Commons community,
Implementing Zoning By-law amendments for the final phase of a draft plan of
subdivision, File No’s.: ZA 08 121722
and SU 02 113757 (19TM-02008 – Final Phase)”, dated May 19, 2009 be received;
2) That application ZA 08 121722 for amendments to Zoning By-laws 304-87, as amended and 177-96, as amended, be approved;
3) That the draft amendments to Zoning
By-laws 304-87, as amended and 177-96, as amended, attached to this report
(Appendices A and B) be finalized and enacted without further notice;
4) That conditional 2011 servicing
allocation for 91 units (336.7 pop.) be granted to plan of subdivision 19TM-02008 – Final Phase, from the
total allocation for the Wismer Commons
community, assigned in accordance with the
5) And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

The purpose of this report is to provide background information regarding applications for draft plan of subdivision approval and implementing zoning by-law amendments within the Wismer Commons community, and to recommend that the implementing zoning by-laws be enacted and that conditional 2011 servicing allocation be granted.
On
Committee was advised by staff at the public meeting that there was an issue with respect to proposed townhouse units fronting the east side of Hammersly Boulevard, south of Bur Oak Avenue (Figure 2), which are not consistent with staff’s concept plan for the Highway 48 corridor which identifies a portion of a park on the lands. The concept plan, which applies to a number of properties, currently has no official status and the area of the proposed park remains to be determined. The proposed townhouse units comply with the Wismer Commons Secondary Plan. The applicant has agreed to a dual residential/open space zoning on the lands and the inclusion of a condition in the conditions of draft plan of subdivision approval that will address the issue of the potential future parkland requirements in this area. The Hold provision on the zoning of the lands for servicing allocation purposes will restrict development on the lands until at least mid 2010.
Staff have completed their review and evaluation of the applications, and the proposal is acceptable to staff. Therefore, in accordance with the Public Meeting resolution, the draft implementing zoning by-law amendments (Appendices A and B) may now be finalized for enactment. The by-law amendments include Holding provisions that may be removed once servicing allocation is confirmed by the Region of York.

ALIGNMENT WITH STRATEGIC PRIORITIES:
The proposed applications will align with the Town’s strategic priorities of Growth Management and Municipal Services by implementing the proposed development in coordination with available servicing allocation.
The applications have been reviewed by various Town departments and external agencies. Requirements of the Town and external agencies will be reflected in the conditions of draft plan of subdivision approval and the implementing zoning by-law amendments.
