                                            Application by the Catholic Cemeteries Archdiocese of Toronto to permit an increase in capacity in Phase 1 of Christ the King Cemetery

                                            7770 Steeles Avenue East

RECOMMENDATION:

1)                  That the report entitled “Application by the Catholic Cemeteries Archdiocese of Toronto to permit an increase in capacity in Phase 1 of Christ the King Cemetery, 7770 Steeles Avenue East” be received;

 

2)                  That the application by the Catholic Cemeteries Archdiocese of Toronto to permit an increase in capacity in Phase 1 of Christ the King Cemetery at 7770 Steeles Avenue East, be approved;  

 

3)         That notice of Council approval be given to the applicant and the Registar in accordance with the Cemeteries Act (Revised);

 

4)         And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to recommend approval of an application to increase the capacity of the approved first phase of Christ the King Cemetery at 7770 Steeles Avenue East as required under the Cemeteries Act.  The increase in capacity consists of the addition of family mausoleums, lawn crypts and a columbarium.

 

BACKGROUND:

Property and Area Context

The approved Phase 1 lands consist of approximately 30 hectares (74 acres) within the larger 70 hectare (173 acre) cemetery property located on the north side of Steeles Avenue, east of Reesor Road (Figure 1).   The larger cemetery property contains natural features including a woodlot and tributary of the Little Rouge Creek.  The property also contains a number of heritage buildings, and an aboriginal archaeological site situated centrally within the cemetery lands.

 

Official Plan, Zoning and Site Plan Approval

The land use approval for Christ the King Cemetery was enacted by way of a Ministerial Zoning Order issued by the Minister of Municipal Affairs and Housing on December 19, 2001. 

 

A site plan application for Phase 1, located in the southwest portion of the property just north of Steeles Avenue, was approved in 2003 (Figures 3 and 4).  The associated Phase 1 site plan agreement contains provisions related to protection of the heritage buildings, the archaeological site, the tributary and the woodlot on the larger property.  

 

Proposal

The proposal is to increase the capacity of Phase 1 by adding three private family mausoleums, four lawn crypts and a columbarium in the area of an existing columbarium off the future access road from Steeles Avenue (Figure 5).  The applicant indicates that the family mausoleums are approximately 1.8m (6 ft) wide and 1.8m (6 ft) long with a height of approximately 2m (7 ft).  The lawn crypts are approximately 1.8m (2ft) high and 2m (7ft) long.  The columbaria are wall-like structures, the largest of which is approximately 2.7m (9ft) tall and 1.5m (5ft) wide.  The existing columbarium in the vicinity of the proposed structures did not require a similar Council approval, as it did not meet the size requirements for approval under the Cemeteries Act.  Illustrations of the structures are provided in Appendix ‘A’.    

 

 

OPTIONS/ DISCUSSION:

Cemeteries Act established procedures for increasing the capacity of a cemetery

A proposal to increase the capacity of a cemetery, including the establishment of a mausoleum, lawn crypts and a columbarium, requires approval from the Ministry of Consumer and Business Services, under the Cemeteries Act (Revised).  Prior to applying for consent from the Registrar, the owner is required to first obtain approval from the Town.  Once a decision has been made, the Act requires the municipality to send a copy of the decision to the applicant and the Registrar, and to publish a Notice of Decision in a local newspaper, with respect to the approval.

 

An appeal to the Ontario Municipal Board (OMB) may be made within 15 days after publication of the Notice of Decision.  The applicant, Registrar appointed under the Cemeteries Act (Revised), or any person with an interest in the matter, may appeal the decision to the OMB.

 

The approved Phase 1 site plan indicates a TRCA conservation easement immediately to the west of the proposed structures, and a Region of York existing and future easement to the south.  The purpose of the TRCA easement is to conserve trees along an original driveway from Steeles Avenue.  The existing and future Region of York easements protect for the existing York Durham Sanitary Sewer (YDSS) and a future twinning of the YDSS.   

 

The Region of York has indicated by email to the applicant that the future easement for the YDSS is no longer required.   The siting drawing shown in Figure 5 indicates that the proposed structures do not encroach on the above-noted TRCA or YDSS easements.  The structures are also approximately 400 metres from the nearest limit of the archaeological site (as defined by an archaeological easement), which is in a future phase of the cemetery.   

Conclusion

Staff recommend approval of the application to increase the capacity of the cemetery.
