RECOMMENDATION:

 

1)                  That the report titled, “PRELIMINARY REPORT, Goldbrite Trading Company Ltd. Zoning By-law amendment application to permit a day care centre at 7750 Kennedy Road (south-west corner of Kennedy Road and 14th Avenue), ZA 09 116954”, be received;

 

2)                  That a Public Meeting be held to consider the Zoning By-law amendment application (ZA 09 116954) submitted by Goldbrite Trading Company Ltd;

 

3)                  And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

Goldbrite Trading Company Ltd. has submitted an application to amend the Zoning By-law to introduce a day care centre as a permitted use at 7750 Kennedy Road.  The purpose of this report is to provide preliminary information on the application and to recommend that a statutory Public Meeting be held with respect to this application.

 

BACKGROUND:

Subject property and area context

7750 Kennedy Road (the “subject property”) is located at the south-west corner of Kennedy Road and 14th Avenue (Figure 1).  An existing commercial/retail plaza with uses such as restaurants, offices, spa, bakery, social club and dry cleaners, currently occupies the subject property.  Commercial and restaurant uses, institutional (Milliken Community Centre) and residential uses surround the subject property. 

 

 

 

Proposal is to introduce a day care centre within the existing plaza

Goldbrite Trading Company Ltd. has submitted an application to amend the Zoning By-law to permit a day care centre.  The proposed day care centre will be approximately 492.3 m2 (5,300 ft2) and be located within the vacant unit in the middle area of the existing plaza (Figure 4).  The applicant is proposing to provide the required outdoor play area on the second storey and roof area of the building.  The proposed 1200 ft (112 m2) outdoor play area would have a wood deck and high fence screen.  The design and height of the deck and fence still needs to be examined in more detail.  The applicant has indicated that there will be an estimated maximum of 50-60 children with approximately 8 staff members.

 

Zoning By-law amendment is required to permit the proposed day care centre

The Official Plan designates the subject property “Commercial-Community Amenity Area” which provides for day care centres, retail and service uses, offices, entertainment and recreational uses, restaurants, private and commercial schools.  A Zoning By-law amendment is required as the subject property is zoned “Special Commercial One (SC1)” which does not permit a day care centre.

 

 

OPTIONS/ DISCUSSION:

The following is a brief summary of concerns/issues raised to date:

 

  • Quality and safety of the rooftop outdoor play area for the proposed day care centre will be examined as a part of this application.  Rooftop exposure, storage equipment, snow removal, fire access and other matters related to the proposed outdoor play area will also be examined. The applicant will provide staff with examples of similar rooftop outdoor play areas for review.  Town staff will consult with the regulating Provincial  Ministry respecting the proposed day care centre and proposed rooftop play area (see below);
  • A license from the Ministry of Community and Social Services will be required to enable the proposed day care centre to operate.  The Ministry regulates the building and space, quality of playgrounds, programs and activities, equipment, health and safety, among other things.
  • Drop-off and pick-up for the proposed day care centre will need to be appropriately delineated and adequate parking provided to facilitate the proposed day care centre;
  • Compatibility of the proposed day care centre with other uses within the plaza;
  • The Region of York will determine if a Traffic Impact Study is required to facilitate the proposed day care centre and provide any additional comments; and
  • Site plan approval is required, in addition to the zoning amendment, before the proposed day car centre can proceed.
