1) That the report entitled “Victoria Square Community Sanitary Sewer and Watermain System Installation” be received; and,
2) That the Asset Management Department be authorized to retain in accordance with the Purchasing By-law
#2004-341 an engineering consulting company to undertake the detailed design
and construction tendering of the Victoria Square Community Sanitary Sewer and
Water System Installation; and,
3) That a capital project be established in the Asset Management Department for the detail design, construction tendering and all related administrative costs to an upset limit of $90,000; and,
4) That the cost for functional review,
detailed design, construction tendering, and all
related administrative costs estimated at $90,000 be up fronted by the Town
from the Waterworks Stabilization/Capital Reserve Fund and if the project proceeds recovered from the
benefiting property owners with appropriate interest; and,
5) That when the tender price is known, the residents of Victoria Square Community be advised of the total project costs, for their decision whether to proceed with the construction of this project; and,
6) That
the Asset Management Department staff report back on the residents’ decision
and staff recommendation; and,
7) That
if the Victoria Square Community Sanitary Sewer and Water System is
to proceed, the total project cost be up fronted by the Town and recovered by
imposing an equal fee against the benefiting property owners abutting the works
in accordance with Section 391 of the Municipal Act 2001; and further,
8) That Staff be authorized and directed to do all things necessary to give effect to this resolution.

The purpose of this report is to obtain Council authorization to proceed with detailed design and construction tendering of the Victoria Square Community Sanitary Sewer and Water System.

Community is located on the north-west and north-east corners of Elgin Mills

Based on the legal opinion provided by the Legal Department, Group 1A area residents cannot be charged for any part of constructing the facilities to service the Group 2 properties as the Group 1A Lots lie along the existing sewer system constructed by the Developer. These property owners have the right to connect to the existing sewer and are responsible only for the costs of the individual service connections.

Note: Group 1A will not be considered as an
improvement project to be funded by the community as these residents have the
option to connect to the existing sanitary sewer fronting their lots.
If authorized by Council, a budget of approx. $90,000 will be required to
fund the cost for detail design, construction tendering, and all related
administrative costs. This cost will be
funded from the Waterworks Stabilization/Capital
Reserve Account and
recovered from the benefiting property owners if the project is to proceed.
If the Victoria Square Community Sanitary Sewer and Water System is to proceed, the total project
cost will be front-ended by the Town and recovered by imposing an equal fee against
the benefiting property owners abutting the works in accordance with Section
391 of the Municipal Act. The By-Law
will provide the residents with the option of paying the full amount either as
one interest free lump sum payment or in equal annual instalments up to a
maximum of 20 years with interest payable at the same rate as the current
Region of York Debenture Interest Rate.
Payment in full of the outstanding balance plus accrued interest would
be permitted at anytime.
If the Victoria Square Community Sanitary Sewer and Water System does not proceed with the construction, the $90,000 will not be recovered from the property owners.
Eliminating the existing septic system and replacing with the sanitary sewer system will reduce the sulphur loading in soil and water in the nearby areas and enhance the overall environment.

The Finance Department has been consulted, provided input and reviewed this report. The Finance Department concurs that funding will be available from the Waterworks Stabilization/Capital Reserve Fund for the detailed design and preparation of the tender documents.
