                                            Little Treasures Pre-School Inc.

                                            Application for Zoning By-law Amendment to permit a daycare/pre-school at the northeast corner of Bur Oak Avenue and Highway 48.

RECOMMENDATION:

1)                  That the report dated May 18, 2010 entitled “Preliminary Report, Little Treasures Pre-School Inc., Application for Zoning By-law Amendment to permit a daycare/pre-school at the northeast corner of Bur Oak Avenue and Highway 48, File Number ZA 10-114981” be received;

 

2)                  That Staff be authorized to schedule a statutory Public Meeting to consider the proposed zoning by-law amendment application;

 

3)                  And that Staff be authorized and directed to do all things necessary to give effect to this resolution.

PURPOSE:

The purpose of this report is to provide preliminary information regarding an application for a Zoning By-law Amendment to add a daycare/pre-school as a permitted use to the lands at the northeast corner of Bur Oak Avenue and Highway 48. 

 

The report also seeks authorization to hold a statutory public meeting with respect to the proposed Zoning By-law amendment application.  This report contains general information in regards to applicable Official Plan and other policies as well as other issues and the report should not be taken as staff’s opinion or recommendation on the application.

 

BACKGROUND:

Property and Area Context

The subject property is approximately 1.05 hectares (2.59 acres) in area, located at the north east corner of Highway 48 and Bur Oak Avenue.  The lands contain a single storey, industrial/commercial building with a variety of uses including a take-out restaurant, medical office and an animal clinic.  The area context is as follows:

 

§  To the north of the subject lands are several single storey, multi-tenant industrial/commercial buildings.

§  To the south is the commuter parking lot for the Mount Joy GO Train Station. 

§  To the west, across Highway 48 is a vacant property recently site plan approved for a Shoppers Drug Mart and other retail pads.  Southwest across Highway 48 are vacant lands intended to be developed with apartment buildings with grade related commercial retail uses.

§  To the east are one-storey commercial/industrial buildings and a car wash, and further east, across the railway tracks is the Greensborough residential community.

 

The proposal is to add a daycare/pre-school to the list of permitted uses

The proposed zoning by-law amendment is to add a daycare/pre-school to the list of permitted uses on the property.  The applicant intends to operate the daycare/pre-school out of one unit in the existing building.  No interior or exterior changes to the building are being proposed.  The use is intended to operate as a pre-school however the structure of their programming is regulated under the Day Nurseries Act.  A portion of the facility operates as a clinic for children with autism under the direction of a psychologist.  The applicant is proposing to combine their pre-school program with the clinic.  Since the facility only operates for 3.5 hours during the day, the requirements for outdoor amenity space under the Day Nurseries Act do not apply.

 

OPTIONS/ DISCUSSION:

Official Plan and Zoning

The subject lands are designated “Major Commercial Area” in the Town of Markham Official Plan, as amended.  This designation provides opportunities for multi-use, multi-purpose centres offering a range of retail, service, community, institutional and recreation uses, and provides for the proposed use. 

 

The site is zoned Select Industrial with Limited Commercial (MIC) under By-law 88-76, as amended.  A zoning by-law amendment is required to accommodate the use. 

 

POTENTIAL BENEFITS OF THE PROPOSAL:

§  The proposed use provides child care services to the residents in Markham.

 

CONCERNS / ISSUES TO BE RESOLVED

No concerns/issues have been raised to date.  Any matters identified through the circulation and detailed review of the proposal will be addressed in a final staff report, if required, at a later date.

The application has been circulated to various Town departments and external agencies and is currently under review.  Requirements of the Town and external agencies will be reflected in the preparation of the Zoning By-law amendment, if approved.

 

CONCLUSIONS:

Staff recommend that a statutory public meeting be held to consider the proposed amendment.
