SUBJECT: Thornhill C.C. & Library (TCC&L) Asbestos Abatement and Reinstatement

RECOMMENDATION:
1) That the report entitled “Thornhill C.C. & Library (TCC&L) Asbestos Abatement and Reinstatement” be received;
2) And That Council approve the reallocation of the uncommitted budget of $539,000 to the Charterhouse Projects Inc. construction contingency purchase order for the purpose of asbestos abatement and the reinstatement of the areas at the TCC&L as outlined in Attachment 2;
3) And That additional construction contingency in the amount of $539,000 be funded from 070-5350-10511-005 TCC&L Construction Contingency,
4) And That Staff be authorized and directed to do all things necessary to give effect to this resolution.
To seek Council authorization to utilize the $539,000 uncommitted budget of the TCC&L Addition and Renovations with respect to the asbestos abatement and reinstatement, in compliance with the Infrastructure Stimulus Fund (ISF) agreement.
In
June 2009, the Town of Markham received ISF’s approval of $6,000,000 project
cost for the Addition and Renovations at the TCC&L as well as $3,200,000
for Facility Accessibility Retrofits at ten Town of Markham Recreational
facilities with TCC&L being identified as one of the locations. Both
projects are funded equally by the Federal & Provincial Governments and the
Town of Markham.
The
following 3 projects are currently underway at the TCC&L:

Original Project- Additions and Renovations of the Community Centre and
Library.
·
Facility Accessibility Retrofits – Changes/additions to various areas
throughout the facility.
·
Asbestos Abatement (Commenced under construction contingency).
On
February 23, 2010, Council awarded the original construction tender 027-T-10 (Attachment
1, Council Extract) to the low bidder Charterhouse Projects Inc. The construction
at TCC&L began on March 31st, 2010 and as per the stimulus
agreement, ISF requires the project to reach substantial project completion by
March 31st, 2011. While an extension to the stimulus program was
just recently announced, Staff intends to achieve the March 31st
completion date, so that the community centre can resume normal operations. As well, the contractor has confirmed in their
construction schedule to complete the Library on January 25, 2011, so that
Library Staff can start the installation of shelves, books etc.
The
work of Facility Accessibility Retrofits project at TCC&L began on November
16th and is expected to last between 60 to 90 days.
Prior
to TCC&L construction, a Designated Substance Report (DSR) was required
& completed prior to construction to identify the presence of any
‘hazardous’ substance as defined by the Province. The DSR identified areas in TCC&L where construction
was to occur. The report identified that
although some areas were of concern, no asbestos was identified within the
confines of the affected construction areas.
During
the construction on Facility Accessibility Retrofits project within the
TCC&L, the Town received a second DSR from another environmental company that revealed
an asbestos concentration. The Town
issued a stop work notification to the General Contractor (Charterhouse) for
TCC&L construction in order to assess and validate this new report. As a result, a third DSR was conducted by Cardinal
Environmental. The results confirmed the presence of asbestos in 7 areas
as outlined in Attachment 2.
On September 2nd, 2010,
TCC&L proceeded with the asbestos abatement under the construction
contingency at various areas in the front lobby. This was to ensure the construction of the
new East courtyard entrance would continue.
Town of Markham Health and Safety Coordinator has diligently advised
Charterhouse that the asbestos is being removed properly.
The current scope of the asbestos
abatement is being completed by Restoration Environmental (REC) and is overseen
by Cardinal Environmental. Charterhouse is
coordinating all work in conjunction with the three project schedules occurring
within the building. The abatement has commenced
as of Wednesday, November 23rd, 2010 at the cost of $175,000. Funds
were provided from the construction contingency account as identified above.
Due to the asbestos abatement and in accordance
with the Ontario Building Code, the removal of dry wall and stucco ceilings
throughout the TCC&L will require the installation of a new fire sprinkler
system. The new T Bar ceilings will provide easy access for future maintenance
and the new energy efficient light fixtures will provide better lighting
levels.
Staff are seeking authorization to utilize
the remaining budget balance of $539,000 for the reinstatement (dry wall,
ceilings, sprinkler systems, lighting fixtures). Although the project has realized unforeseen
costs, the project remains within the allocated budget as identified under
financial considerations.

As per Council report dated February 23rd,
2010, there is an uncommitted budget of $539,000 due to favourable pricing
received from the construction tender. In
addition, there is a construction contingency set up in the amount of $471,000
of which approximately $460,000 is unspent.
The total available budget to cover the abatement and reinstatement will
be $999,000.
