Miscellaneous Street Issues - Cornell Community Phase 1

 

 

 


 

 

RECOMMENDATION:

That a By-law to rename Lane C, Registered Plan 65M-3202 and a portion of Lane A, Registered Plans 65M-3243 and 65M-3507 to Milroy Lane and to rename a portion of Lane W, Registered Plan 65M-3294 to Winkler Lane be considered by Council at its meeting on February 11, 2003 and that notice be provided on the Council meeting agenda and on the Town’s website in accordance with Notice By-law 2002-275 and that notice also be provided by one publication in the Markham Economist & Sun;

 

And That a By-law to permanently close a portion of The Meadows Avenue, Registered Plan 65M-3202 and Registered Plan 65M-3507 be considered by Council at its meeting on February 11, 2003 and that notice be provided on the Council meeting agenda and on the Town’s website in accordance with Notice By-law 2002-275 and that notice also be provided by one publication in the Markham Economist & Sun.

 

PURPOSE:

The purpose of this report is to provide information to Council with respect to the naming of two lanes and the closing of a portion of a street in the Cornell community (Figure 2).

 

BACKGROUND:

 

Naming of Milroy Lane and Winkler Lane

Seventy residential lots within the first phase of Cornell have their frontages on the Golden Jubilee Greenway, overlooking Ninth Line.  However, all of these lots have their municipal addresses on other streets and lanes located at the rear of the properties.  Ten of the lots are addressed onto Riverlands Avenue, 35 lots onto Milroy Lane, 8 lots onto Cornell Common Road, 15 lots onto Pascoe Drive, and 2 lots onto Winkler Lane.

 

At the time of registration of the plans of subdivision, the lanes in Cornell were not provided with names, but rather were identified by a letter.  Milroy Lane, running north from Settlement Park Avenue to Cornell Park Avenue, and Winkler Lane, running north of White’s Hill Avenue, were subsequently provided with their names by resolution of the Minor Applications Committee in August 2001 in order to allow all of the lots fronting onto the Greenway to be addressed from the rear of the lot.  It is now necessary for Council to pass a By-law that would be registered on title in order to legally effect the endorsed name changes (Figure 2).

 

Closing of The Meadows Avenue west of Milroy Lane

The Meadows Avenue, running east-west through the first phase of Cornell, was originally intended to intersect with 9th Line opposite Merlin Gate, as provided for in registered plans of subdivision 65M-3202 and 65M-3507.  In February 2000, in response to concerns that were raised by area residents about potential traffic infiltration into the neighbourhoods west of 9th Line, Council resolved to terminate The Meadows Avenue at Milroy Lane.  It is now necessary for Council to pass a By-law that would be registered on title in order to legally close the street (Figure 2).

 

OPTIONS/DISCUSSION:

 

Milroy Lane and Winklers Lane have already been signed and addressed.  The section of The Meadows Avenue between Milroy Lane and 9th Line was never physically opened and is being developed as a landscaped parkette.

 

In order for Council to pass the required By-laws, Notice By-law 2002-275 requires that notice of intent must first be posted on the Town’s website and on the Council agenda.  It is the opinion of Staff that it would also be advisable to provide one publication, prior to enactment, in the Markham Economist & Sun.  If authorization to proceed were to be given at this time, the required notice could be provided prior to the Council meeting scheduled for February 11, 2003, allowing Council to hear from any concerned persons and pass the required By-laws at that meeting.

 

FINANCIAL CONSIDERATIONS:

No financial implications are to be considered in this report.

 

BUSINESS UNITS CONSULTED AND AFFECTED:

Planning staff have worked with Street Services staff in the legal surveying of the affected streets and with staff in the Clerk’s Department on matters of procedure.
