RECOMMENDATION:
THAT Heritage Markham’s recommendation to
designate the John D. Hess House at 5928 16th Avenue and the Christian
Ramer Tenant House - 5958 16th Avenue under Part IV of the Ontario
Heritage Act be approved;
AND THAT the Clerks Department be authorized to:

publish and serve Council’s Notice of Intention to
Designate as per the requirements of the Act; and,
·
prepare the Designation By-law for this property.
AND THAT the Town enter into a heritage conservation easement agreement
with the owner of the property at 5928 & 5958 16TH Avenue to
ensure the protection of the John
D. Hess House and the Christian Ramer Tenant House;
PURPOSE:
To recommend to Council that the John D. Hess House at 5928 16th
Avenue and the Christian Ramer Tenant House - 5958 16th Avenue be designated under Part IV of the Ontario Heritage Act.
and that the Town enter into a heritage easement agreement with the owner for
the preservation of both buildings.
BACKGROUND:
The properties at 5928 and 5958 16th Avenue contain two heritage buildings known as the John D. Hess House and the Christian Ramer Tenant House. These properties are located adjacent to the Markham Village Heritage Conservation District, the Markham Museum and the Markham Heritage Estates Subdivision
The lands are currently the subject of an application by Graywood
Developments Ltd. for rezoning, Official Plan Amendment and site plan control
to permit construction of a two-storey, 90 unit retirement home facility for
Alert Care Ltd.. As per the heritage
policies of the Town of Markham Official Plan, the owner of the subject
property, Lylia Geraldine Jones and the prospective purchaser of the subject
lands, Alert Care Ltd., through their agent Graywood Developments Ltd.. have
agreed to incorporate the existing heritage homes within the new
development. The applicants are
proposing to retain and restore the house at 5928 16th Avenue on its
existing site and to relocate the front section of the house at 5958 16th
Avenue adjacent to the house at 5928 16th Avenue where it will also
be restored (See Appendix “C”).
In order to ensure that the existing heritage buildings are protected
prior to and during the development process, Heritage Markham at its meeting of
December 11, 2002 recommended that the John D. Hess House at 5928 16th Avenue and
the Christian Ramer Tenant House - 5958 16th Avenue be designated
under Part IV of the Ontario Heritage Act. and that the owner enter into
a heritage conservation easement agreement for the dwellings with the
Town. The purpose of the designation
and heritage easement is to ensure the long-term protection of the buildings
and to provide current and future owners access to available funding programs
for the restoration of the designated heritage property.
DISCUSSION:
John D. Hess House
and the Christian Ramer Tenant House are significant heritage buildings
The John D. Hess House and the Christian Ramer Tenant House are listed on the Markham
Inventory of Heritage Buildings.
The John D. Hess House is a good example of a brick farmhouse from the
mid 19th Century built for a prominent farming family in Markham and
the Christian Ramer Tenant House is a good example of a vernacular frame house
also from the late 19th Century, which once stood at the gateway to
Markham Village. The buildings exhibit
influences of vernacular, and rural Gothic Revival styles. An outline of the cultural heritage value
and specific heritage attributes of both houses is included in the Heritage
Designation Reports, which are attached as Appendix ‘A’ and ’B’.
It is recommended that the buildings be designated under the Heritage
Act.

Action required
by Clerks Department
Should Council concur with the recommendation to designate the John D. Hess House at 5928 16th
Avenue and the Christian Ramer Tenant House - 5958 16th Avenue, the Clerks
Department should be authorized to:

publish and serve on the property owners, the
Ontario Heritage Foundation and the public through a newspaper advertisement,
Council’s notice of intention to designate the property as per the requirements
of the Act; and,
·
prepare the Designation By-law for the property at
5928 and 5958 16th Avenue.
Action
required by Legal Services Department
Should
Council concur with the recommendation to authorize the Town to enter into a
heritage conservation easement agreement the John D. Hess House at 5928 16th Avenue and
the Christian Ramer Tenant House - 5958 16th Avenue, the Legal
Services Department should prepare the heritage conservation easement agreement
and forward it to the Owners and authorized Town officials for endorsement and
execution.
