BY-LAW 2011-249

 

A by-law to appoint alternate Deputy Mayors for

The Corporation of the Town of Markham

 

WHEREAS the statutory duties of the Mayor of The Corporation of the Town of Markham are outlined in Section 225 of the Municipal Act, 2001 and various other Acts; and,

 

WHEREAS the Mayor is also responsible for executing various other duties for The Corporation of the Town of Markham as authorized by Council, including those identified in the Markham Emergency Management Plan; and,

 

WHEREAS Council appoints the Regional Councillor who received the highest number of votes cast in the Regional Councillor race as Deputy Mayor every term of Council; and

 

WHEREAS it is prudent to establish the duties of the Deputy Mayor in the absence of the Mayor and to provide for alternate Deputy Mayors in the absence of both the Mayor and the Deputy Mayor;

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF MARKHAM HEREBY ENACTS AS FOLLOWS:

 

1.                  That the Deputy Mayor fulfill all obligations of the Mayor, as set out in the Municipal Act, 2001, as amended, the Emergency Management and Civil Protection Act, R.S.O. 1990, c. E.9, as amended, any other applicable legislation, and any resolution of the Council of the Town of Markham, in the absence of the Mayor.

 

2.                  That the Regional Councillor who receives the second highest number of votes cast for the Regional Councillor race in the most recent Municipal Election is hereby appointed as the first alternate Deputy Mayor for The Corporation of the Town of Markham, effective in the absence of the Mayor and the Deputy Mayor.

 

3.                  That Regional Councillor who receives the third highest number of votes cast for the Regional Councillor race in the most recent Municipal Election is hereby appointed as the second alternate Deputy Mayor for The Corporation of the Town of Markham, effective in the absence of the Mayor, the Deputy Mayor and first alternate Deputy Mayor.

 

4.                  That Regional Councillor who received the fourth highest number of votes cast for the Regional Councillor race in the most recent Municipal Election is hereby appointed as the third alternate Deputy Mayor for The Corporation of the Town of Markham, effective in the absence of the Mayor, the Deputy Mayor, first alternate Deputy Mayor and second alternate Deputy Mayor.
