Designation Under Part IV of the Ontario Heritage Act

Henry Pingle Sr. House

9767 Kennedy Road

RECOMMENDATION:

THAT the “Henry Pingle Sr. House” at 9767 Kennedy Road be approved for designation under Part IV of the Ontario Heritage Act,

 

AND THAT the Clerk’s Department be authorized to:

  • publish and serve Council’s Notice of Intention to Designate as per the requirements  of the Act; and

 

  • prepare the Designation By-law for the property.

 

 

PURPOSE:

To recommend to Council that the “Henry Pingle Sr.  House” (historical reference) at 9767 Kennedy Road be designated under Part IV of the Ontario Heritage Act.

 

BACKGROUND:

The building is listed on the Inventory of Heritage Buildings

The subject property contains a heritage building that is listed on the Markham Inventory of Heritage Buildings and is identified in the Berczy Village Secondary Plan (Appendix IV – Heritage Buildings) as a building of heritage significance. The Designation Report for this property is attached as Appendix “A.”

 

 

 

 

The house was built as a brick, one storey Regency Cottage c.1849. The original owner was Henry Pingle Sr., a member of one of the Berczy settler families. In 1924, the Weatherill family remodelled the house in the Arts and Crafts mode of the day, transforming it to its present one and a half storey form and cladding the brick in stucco. Interestingly, many features associated with the earlier stage in the building’s history were left intact and can still be discerned within the remodelled structure. The house at 9767 Kennedy Road is a remarkable example of an evolved building, indicating the changing architectural tastes and requirements of different families through time.

 

Heritage Markham evaluated this building as part of the Berczy Village Secondary Plan process

In 1994, the Henry Pingle Sr. House was evaluated as a Group 2 heritage building as part of the Berczy Village Secondary Plan process. In 2002, Heritage Markham re-evaluated this building as a Group 1 Heritage Building based on further research.  Buildings of this status are typically recommended for designation under Part IV of the Ontario Heritage Act.

 

The Henry Pingle Sr. House was recommended for preservation within any future development of the property

In 2003, Heritage Section Staff prepared a report to the Development Services Committee which outlined the significance of the building, reviewed issues with the property owner regarding its heritage status, and recommended that the building be preserved within any future development of the property, preferably on its original foundation. The recommendation also allowed for the house to relocated within the development site in consideration of development constraints on this remnant parcel (see Appendix ‘B’ - Council Extract, dated February 11, 2003).

 

The current owner proposes to preserve the heritage house within a plan of subdivision

In November of 2003, the property changed hands. In 2005, applications for Subdivision and Zoning Amendment were received for the subject property. The current owner, Fairglen Homes Limited, supports the designation of the property and has submitted a concept plan showing how the house will be relocated a short distance from its existing site and integrated into the proposed plan of subdivision. A public meeting regarding the above-noted applications was held on August 30, 2005.

 

Heritage Markham has commented on current applications for draft plan approval for a subdivision and zoning by-law amendment

Heritage Markham reviewed the current planning applications at their meeting of April 25, 2005. The committee’s main concern is that the house be sited on an appropriately-sized lot within the plan of subdivision, acknowledging that the building will have to be moved a small distance within the development parcel to facilitate efficient development of the lands.

 

Heritage Markham recommends designation under Part IV of the Ontario Heritage Act

At its meeting of August 10, 2004, Heritage Markham recommended that the Henry Pingle Sr. House be designated under Part IV of the Ontario Heritage Act.  (See Heritage Markham Extract, attached as Appendix “C.”) The property owners have been advised of this recommendation through their agent and have not raised any concerns as it is their intention to preserve the building on the development site within the context of future development.

DISCUSSION:

 

The preservation and designation of the Henry Pingle Sr. House is consistent with the policies of the Berczy Village Secondary Plan

The Secondary Plan for the Berczy Village Secondary Plan Area contains Cultural Heritage policies (See Appendix ‘D’). Briefly, these policies provide for the retention and conservation of significant heritage buildings and their integration into development proposals. Appendix IV of the Secondary Plan lists 8 heritage buildings, including the Henry Pingle Sr. House at 9767 Kennedy Road. Significant heritage buildings are typically given recognition and protection through designation under the Ontario Heritage Act. The preservation and designation of this building is consistent with the policies of the Berczy Village Secondary Plan.

 

The applicant is in agreement with Heritage Markham’s recommendation to designate

The applicant, through their agent, has been working with Heritage Markham and Heritage Section staff to integrate the Henry Pingle Sr. House into the proposed plan of subdivision, and is aware of Heritage Markham’s recommendation to designate the property under Part IV of the Ontario Heritage Act. The applicant has indicated that they are in support of the designation.

 

Should Council decide to proceed with the recommendation to designate 9767 Kennedy Road under Part IV of the Ontario Heritage Act, the Clerk’s Department should be authorized to:

 

  • publish and serve on the property owner, the Ontario Heritage Trust and the public  through a newspaper advertisement, Council’s notice of intention to designate the property as per the requirements of the Act; and

 

  • prepare the designation by-law for the property.

 

FINANCIAL CONSIDERATIONS:

There are no financial implications to be considered in this report.

 

ENGAGE 21ST CONSIDERATIONS:

Heritage designation helps to achieve a quality community by recognizing, promoting and protecting a heritage resource, which strengthens the sense of community.

 

 

BUSINESS UNITS CONSULTED AND AFFECTED:

Acceptance of this recommendation to designate 9767 Kennedy Road will require the Clerk’s Department to initiate the notice process and prepare the designation by-law.
